Chief charter drafter Meechai Ruchupan insisted on Thursday that the new law to allow court trials in absentia was not designed to deprive defendants of their rights.
Meechai said the Election Commission (EC) had proposed initiating both investigations in absentia and the prolonging of the prescription period.
But the Constitution Drafting Commission believes the latter measure will make trials more difficult, he said.
“The defendants will face more troubles. Let’s say, the witnesses die when the trial has not reach a conclusion,” the chief drafter said.
He argued that enabling the process to go on instantly would be more advantageous.
Also, the new charter allows political office-holders found guilty in the past to lodge appeals under the condition that they present themselves in court, Meechai said.
The CDC last week made public an organic law on procedures for political-office holders which includes clauses to allow judicial procedures regardless of the absence of defendants. It raised questions relating to fairness for the accused.
Meechai said that such an extraordinary procedure would be more advantageous than the normal procedure.
When politicians who befitted from corruption have resources to remain at large, the law enforcement is not feasible, he said, adding that they could also use their resources to unfairly sue people.
But with regards to civil lawsuits, Meechai said the new constitution had prolonged the prescription to 20 years from previously 10. If politicians abused their power in moving a motion in Parliament regarding the state budget, the state can chase compensation within a 20-year period.
