Election Commission (EC) member Somchai Srisuthiyakorn on Thursday sneered at chief charter drafter Meechai Ruchupan who had remarked that taking the case against the organic law to the Constitutional Court would not be easy.
Somchai said Meechai was afraid that the Constitution Drafting Commission (CDC) would lose face if the court’s decision turned out to be in line with the EC’s stance.
Meechai on Wednesday had said that the EC could not petition the Constitutional Court unless the law was already effective.
Somchai said that the EC members, as law enforcers, had no personal interest but were concerned that the bill in question would cause trouble in the future.
The commissioner said that Section 210 of the Constitution stipulated clearly that the Constitutional Court had the authority to consider the constitutionality of any law or “draft law” regardless of whether it had come into effect or otherwise.
Although the organic law had yet to be promulgated, the EC could bring the case to the Constitutional Court, Somchai said.
