Electronic signature law needed to boost e-commerce

THE LAOS government has told the National Assembly (NA) that country needs to have an electronic signature law in place to boost e-commerce and facilitate e-governance.

Presenting the drafted electronic signature law to the NA’s ongoing 6th ordinary session last week for debate, Minister of Post and Telecommunications Thansamay Kommasith said the law was essential.

Members of the NA passed the draft following their one-day debate.

The minister said countries in the region and around the world are modernising and switching to the digital economy. Laos is inevitably part of this changing trend so the law, which officially recognises electronic signatures, is essential to support this change.

He described digitalisation and electronic products driven by the growing development of information communications technology (ICT) as an “effective tool” to hasten socio-economic development.

A number of services such as making contracts, trade, disbursements (money transactions), services, and tax collection among others have been carried out via the electronic system.

“The Lao PDR has already made use of such digital technology. More and more payments of bills are made via electronic systems,” Thansamay said, referring to the payment of electricity and water supply bills, and road tax among others via online banking. The Ministry of Finance will implement e-tax and e-customs next year.

Electronic signatures have has also been in use in the e-passport and e-visa system of the Ministry of Foreign Affairs. Many other state departments are introducing electronic systems to provide public services. Experts at the World Economic Forum 2018 predicted that some countries might stop using paper documents within the next two or three years and replace them with electronic documents.

By between 2025 and 2030, crypto-currencies are expected to be widely used and all economic sectors will be positively impacted by the use of 5G mobile applications inducing non-banking services.

Thansamay, who represented the law drafting sub-committee, said Laos needs to prepare its legal system to handle and support this changing process to ensure safety and security in making use of the electronic documents and signatures.

NA members welcomed the drafted law, agreeing it will give a boost to modernising services and economic development.

Parliament member for Vientiane, Valy Vetsaphong said the development toward industry 4.0 requires such a law to support this process.

Given the growing trend and its significance, NA members underlined the need to include digital and electronic learning in the school curriculum. The drafted law defines principles, regulations and measures to manage electronic signature affairs.

Jetro steps up efforts to link firms to African startups

THE JAPAN External Trade Organisation (JETRO) plans to release a report next year listing 100 promising African startups, as part of efforts to help Japanese companies gain access to the vast, “once-invisible” potential market, its Chairman Hiroyuki Ishige said on December 13.

In recent years, the business environment in Africa has undergone significant change on the back of the rapid spread of mobile communication devices. Startup companies, including mobile phone-based financing service providers and digital business platform operators, have been a driving force in creating new businesses in the region.

“Japanese companies have traditionally focused on resources, energy and infrastructure when doing business in Africa, but I believe we should broaden focus areas by exploring new business opportunities with local startups,” Ishige said at a press conference at the JETRO headquarters in Tokyo.

JETRO believes linking Japanese companies with African startups has great business potential because the startups have access to vast amounts of data through their services, particularly on so-called base of the economic pyramid (BOP) consumers – generally defined as those with annual incomes below $3,000 (Bt98,340) in local purchasing power.

In Nigeria, for example, those with annual incomes of $3,500 or less accounted for 76.8 per cent of the population in 2016, according to a document compiled by JETRO. Japanese companies have mainly targeted higher-income earners, which comprised about 20 per cent of the population that year. “This [BOP] segment used to be invisible due to the lack of market data,” Ishige said.

“By working with the startups, Japanese companies can reach difficult-to-approach consumers.”

JETRO is currently selecting up-and-coming firms in nine African countries, including Kenya, Nigeria and South Africa, with the potential to become business partners or investment destinations of Japanese companies. These firms possess innovative technologies |in fields such as agriculture, |medicine and finance.

The report on 100 startups, which also have the potential to impact society, is scheduled to be released in February ahead of the next Tokyo International Conference on African Development (TICAD), a Japan-initiated forum to be held in Yokohama in August.

JETRO plans to set up a “help desk” at its headquarters where individual Japanese companies seeking to work with African startups could obtain information and assistance. It also intends to widely disseminate such information through its about 50 offices across the nation.

“Japanese participants in business in Africa have mostly been major companies, but we want to expand and diversify participants by also encouraging small and midsize companies to look to Africa,” Ishige said.

INDONESIA’S Communications and Information Ministry is closely monitoring startups that provide digital signatures services to prevent any misuse, an official has said.

To do so, the ministry has armed itself with Ministerial Regulation No 11/2018 on electronic certification vendors, which was issued on September 6.

The regulation contains 14 requirements for the digital signature vendors, including a requirement to possess a local digital signature infrastructure and other facilities that had passed stress testing as well as penetration testing, which evaluates a system’s security through a simulated attack.

The vendors are also required to own a |system that produces and manages digital |signatures as well as a system that issues, manages and guarantees the security of electronic certificates.

Digital signature vendors must also be registered as an electronic system provider (PSE) as stipulated under government regulation (PP) No 82/2012 on implementing electronic transaction systems.

“Digital signature vendors that have not registered [with the ministry] will be producing illegal digital signature products,” the ministry’s information application control director, Riki Arif Gunawan, said in Jakarta on Sunday as quoted by kontan.com.

Marshall Pribadi, the CEO of Privy Identitas Digital (PrivyID), welcomed the regulations as critical to the business’ continuity.

“With the ministry’s close monitoring, the people need not worry about the security or validity of digital signatures,” said Marshall.

The ministry has recognised PrivyID as a digital signature vendor since December 7.

China to lead in AI research

CHINA is set to overtake Europe as the world’s largest contributor to artificial intelligence research within four years, according to a new report.

The study of global AI trends also found that China is attracting more academic talent than it is losing, while Europe, the world’s largest AI research market by its number of publications, is suffering a “brain drain”.

Dutch publisher and analytics company Elsevier carried out the study focusing on the three largest countries and regions contributing to the field of AI – China, the United States and the European Union.

“Europe is still the largest contributor to AI research but continues to lose publication share,” the study authors said. “The United States is regaining ground lost in the last five years. China is bound to overtake Europe in publication output in AI in the near future, having already overtaken the United States in 2004.”

Elsevier analysed the number of research paper publications coming out of regions in five-year periods over the last two decades. It found that Europe’s share of global AI research has consistently decreased.

Europe contributed 35 per cent of publications between 1998 and 2002, falling gradually over each subsequent five-year period to reach 30 per cent between 2013 and 2017.

Meanwhile China’s share has increased dramatically, from 9 per cent of global publications between 1998 and 2002 to 24 per cent between 2013 and 2017.

The US lost ground in each five-year period between 1998 and 2012; however the rate of publications rose slightly between 2013 and 2017 to reach 17 per cent of the global share.

“China’s artificial intelligence research has developed very fast in recent years, increasing its global significance within the field,” said Sun Zhenan, a professor at the Chinese Academy of Sciences’ Institute of Automation.

He added: “China has unique advantages in applied technology research and development, for example, in the area of face recognition. AI education has been receiving more and more attention in recent years, not only in universities, but also in vocational colleges, and even in secondary and primary schools. This growing AI talent base will result in even greater future development of the AI field in China.”

Authors of the report noted that China “aspires to lead globally in AI” and is supported by “ambitious policies and rapid growth”.

A net “brain gain” of AI researchers also suggests an increasingly attractive research environment.

Over the 20-year period, China has experienced a 0.1 per cent surplus in inflow of AI researchers, achieved through a migratory outflow of 3.5 per cent versus an inflow of 3.6 per cent.

The US experienced an inflow surplus of 0.3 per cent over the period. Meanwhile in Europe there was a 7.8 per cent outflow of researchers compared with a 6.8 per cent inflow, contributing to a net loss of AI talent of 1 per cent.

The study also found that AI talent is increasingly migrating from the academic sector into industry, and the rise of large tech companies in the US and China may contribute to the European “brain drain”.

A SPIN-OFF from China’s online retailer Taobao is endorsing a physical store in Malaysia.

Bringing the online shopping experience offline is Lumahgo Sdn Bhd in collaboration with Tmall World – a spinoff of Taobao – and lifestyle furniture retailer, Lorenzo.

The 5,000-sq-ft Lumahgo x Taobao Selection store is on the first floor of Viva Home Shopping Mall in Kuala Lumpur.

“We are developing a new retail system that caters to Malaysians, which will bring a new retail technology experience to local retailers,” said Lumahgo’s chief executive Fabian Kong.

Taobao x Lumahgo was opened by Lumahgo New Retail Sdn Bhd and endorsed by Tmall.

However, the store was not opened by Tmall or Alibaba Group itself.

Through the agreement, Kong said Alibaba Group would provide the company with tools such as big data that targets Malaysian consumers, technology and a platform for local furniture retailers to sell their products.

“We are helping Tmall World to sell the selected products in Malaysia for customers who do not know how to shop online,” said Kong, adding that offline furniture shopping still accounts for 98% of the transactions.

With the new virtual technology introduced, Kong said it allowed customers to visualise and buy the furniture online.

With this partnership, Tmall will promote Malaysian furniture to the world under a multi brand flagship store run by Lumahgo.

The strategic partnership was formed and witnessed by Primary Industries Minister Teresa Kok.

“Our economy has not been very good in the past couple of years, but we have seen an increase in the furniture export industry,” said Kok.

PETALING JAYA: Fugitive financier Low Taek Jho, better known as Jho Low, has denied any wrongdoing in the wake of Malaysian authorities filing criminal charges against Goldman Sachs and several others, including him.

The charges were filed in connection with an investigation into corruption and money laundering at state fund 1Malaysia Development Berhad (1MDB).

A spokesman for Low, through his attorneys, issued a statement on the matter on Monday (Dec 17).

“Mr Low maintains his innocence,” said Wells Haslem Mayhew Strategic Public Affairs co-CEO Benjamin Haslem.

“As has been stated previously, Mr Low will not submit to any jurisdiction where guilt has been predetermined by politics and there is no independent legal process.

“It is clear that Mr Low cannot get a fair trial in Malaysia, where the regime has proven numerous times that they have no interest in the rule of law,” he added.

Low’s current whereabouts remain unknown.

Earlier, in a statement, Attorney General Tommy Thomas said Malaysia will seek jail terms as well as billions in fines from Goldman Sachs and four other individuals who allegedly diverted about US$2.7bil (RM11.3bil) from 1MDB.

According to a Reuters report, this is the first time Goldman Sachs has faced criminal charges in the 1MDB scandal.

Like Low, the bank has consistently denied wrongdoing.

In a statement, a Goldman Sachs spokesman said the bank would vigorously defend against the “misdirected” charges.

The bank continued to cooperate with all authorities in their investigations, he said.

Reports say Goldman Sachs has been under the microscope for its role in helping raise US$6.5bil (RM27.2bil) through three bond offerings for 1MDB, which is the subject of investigations in at least six countries.

The US Department of Justice has said about US$4bil (RM16.7bil) was misappropriated from 1MDB, including some money that Goldman Sachs helped raise, by high-level officials of the fund and their associates from 2009 through 2014.

Thomas said that charges were filed against Goldman Sachs’ former South-East Asia chairman Tim Leissner, former banker Roger Ng, former 1MDB employees Jasmine Loo and Low in connection with the bond offerings.

He added that Ng would be charged shortly.

Eatery owners unhappy over smoking ban

KUANTAN: Eatery owners in Pahang are calling for a win-win solution over the proposed total smoking ban at all open air outlets.

Kuantan Cafe, Hotel and Restaurant Association chairman Sin Thin Sang described the move as too extreme, saying it would burden business owners with unfair penalties and inconveniences.

Having smoking areas within these business premises would be a solution that protects the interest of all parties, he said.

“The Government proposed this without seeking a win-win solution to protect both non-smokers and smokers in our eateries.

“We have workable solutions adopted in other countries with similar open eating places and hope the government will hear us.

“If the Government will listen to our suggestions, we are willing to compromise,” Sin said at a press conference here.

In October, Deputy Health Minister Dr Lee Boon Chye had said smoking in all restaurants, coffeeshops and hawker centres nationwide will be banned starting next year, even in open air eateries.

Those caught smoking at prohibited areas can be fined up to RM10,000 while eateries that fail to enforce the ban may be fined RM2,500.

Sin said this was unfair to eatery operators as it was pushing the responsibility to them to stop customers from smoking.

“What if we tell customers not to smoke but they refuse to listen? The Government cannot expect us to get into fights with our customers over this,” he said.

Sin also said the Health Ministry was not tackling the smoking problem effectively as illegal cigarettes were still being sold everywhere.

“Even with the price increase of cigarettes, the number of smokers are not decreasing. They may be getting their cigarettes from illegal sources.

“Would it not be more effective to eradicate illegal cigarettes so that smokers will give up the habit? Why is the Health Ministry not issuing summonses to those smoking illegal cigarettes but holding us honest business owners liable for failing to stop someone from smoking in our shops,” he said.

Also present at the press conference were Temerloh Coffee Shopkeepers’ Association chairman Foo Kok Chuan and Lipis, Raub and Jerantut Coffee Shopkeepers’ Association president Kong Swee Pin.

They represented some 500 eatery owners in Pahang.

Washington- US President Donald Trump again attacked the Federal Reserve on Monday for considering raising interest rates, on the eve of a meeting at which policymakers are widely expected to do so again.

The Twitter outburst renewed the president’s rock throwing at the central bank, which he accuses of undermining his economic agenda of tax cuts, slashed regulations and multi-front trade offensives.

Trump has repeatedly broken with norms of recent decades, hammering the central bank this year over its moves away from the zero interest rate policy implemented during the global financial crisis.

“It is incredible that with a very strong dollar and virtually no inflation, the outside world blowing up around us, Paris is burning and China way down, the Fed is even considering yet another interest rate hike,” Trump wrote, in a message sent one hour before stock markets were due to open.

“Take the Victory!”

As the US economy has recovered, the Fed has been raising the benchmark lending rate gradually since December 2015.

But Trump has called the central bank “crazy,” “out of control” and a greater economic threat than China, which the president blames for hollowing out American industry through unfair trade.

But analysts and former Fed members say Trump’s unprecedented vitriol could cause the central bank to prove its independence by raising rates even if policymakers might otherwise have held off.

The Fed on Tuesday opens its two-day policy meeting, and is widely expected to raise the key rate for the fourth time this year, working to get ahead of expected gains in inflation.

– Staying out of politics –

Policymakers have offered little reaction to Trump’s string of taunts, with Fed Chairman Jerome Powell saying the political noise does not factor into their decisions.

Inflation is holding right around the Fed’s two percent target, but if markets believe the Fed can be swayed by political pressure, inflation fears could ignite and become a more serious problem.

Amid brisk economic expansion after a decade of steady job growth, US unemployment is flirting with a 50-year low, but the US economy is expected to slow.

And with global economy also weakening, there is a growing feeling the central bank will not have to raise rates as much as previously expected next year.

Powell and other officials in recent weeks have suggested they could show patience in 2019 as they study incoming economic data.

Futures markets currently put the odds of a rate hike this week at about 80 percent.

Thailand sits in the third spot while Indonesia the sixth spot in a list that ranks the number of public holidays designated for 2019 across Southeast Asian countries.

As reported by kompas.com, Malaysia takes the top spot with the highest number of public holidays with 50 days. Second place is occupied by Cambodia with 31 days.

Thailand follows with 26 days in some of its provinces, while the country technically has 20 national holidays. Myanmar residents are set to enjoy 25 public holidays and the Philippines rounds up the top five with 21 days.

Indonesia placed sixth with 20 days, followed consecutively by Brunei with 19 days, Singapore with 14 and Laos with 13. Meanwhile, Vietnam had the least number of public holidays at just 11 days.

Dutch to ban raw ivory sales from 2019

The Netherlands said Monday it will ban all raw ivory sales from next year, as it unveiled the results of a major operation to combat trafficking in endangered animals and plants.

Currently Dutch law permits the sale of raw ivory such as elephant tusks with an EU certificate, provided it entered the country between 1947 and 1990.

“From March 1 2019… the sale of raw ivory from and in The Netherlands will no longer be possible,” Dutch Agriculture and Nature Affairs Minister Carola Schouten said.

“This measure comes because with raw ivory it’s very hard to tell the old from the new,” Schouten said in a letter to parliament.

The old rule came into force shortly after international trade in ivory was banned in 1989 by CITES, the global conference that governs wildlife trade.

Ivory imported into the country before 1947 needed no such certificate, the NOS public broadcaster said.

“But recently acquired ivory is often ‘aged’, for instance by using tea leaves and sold on (Dutch online classified advertising site) Marktplaats,” it added.

By banning all sales of raw ivory, “we are undercutting illegal practices,” Schouten said.

The minister also unveiled the results of a two-month operation by police, customs and food watchdog officials aimed at intercepting endangered species brought into the country illegally.

“Operation Toucan” from September to November saw officials seize thousands of cacti from Panama and Peru without proper import papers as well as a range of exotic animals.

This included six boa constrictors, sent by mail from the United States, a pencilled marmoset and a capuchin monkey which were kept as pets and two dead toucans sent from Uruguay, the minister said.

Dutch police and inspectors also confiscated seven kilogrammes of ivory at a collectors’ fair in the central city of Utrecht.

CITES said last year elephant poaching was declining in Africa but that seizures of illegal ivory were hitting record highs.

In 2016 some 40 tonnes of illegal ivory were seized, the most since 1989, as well as the highest number of “large-scale ivory seizures,” the group said.
