THIS is not the time for the government to be coy about what it wants in relation to joint development of the 873-kilometre medium-speed rail line in the Northeast.

At the 10th Thai-China steering committee meeting scheduled for the end of this month in Beijing, Thailand should convince China to be responsible for at least 70 per cent of the project value.

The other option would be to make China responsible of all parts of the project under the build, operate and transfer scheme. That would require it to transfer all assets to the Thai government once the contract is due, in, say, maybe 30 years, Democrat Party deputy leader Korn Chatikavanijsuggested in a Facebook post.

“We must admit that the State Railway of Thailand does not have enough skill in the operation of high-speed railways,” he pointed out.

Although the project is expected to be beneficial to both sides, China stands to gain more in terms of strategic results. China also has more money and operating skills than Thailand.

Many people are concerned about the deal, fearing that Thailand might be at a disadvantage if the government gets China to develop the project as well as borrow the funds from Beijing to finance it. Moreover, technology like rolling stock and signalling systems, plus contractors and workers will have to be imported from China. In the end, Thailand may have to be responsible for all or most of the risk of investment.

Before the upcoming meeting, the Chinese side is expected to provide feedback on whether it is ready to agree to Thailand’s recent proposals.

Thailand has asked China to adjust the original joint venture or Specific Purpose Vehicle (SPV) of a 60:40 share (only for operating) to a new one in which Thailand holds 30 per cent and China takes the rest. However, the SPV will cover almost all the investment, including civil-engineering work, track-and-signal system installation, plus operations and maintenance.

Meanwhile, China has proposed scaling down construction of the Nakhon Ratchasima to Nong Khai line from a dual-track to single-track. It also wants to delay construction of the line from Kaeng Khoi to Map Tha Phut.

As is widely known, the Sino-Thai rail project – part of China’s 5,500km Trans-Asian Railway running from southern China to Malaysia via Laos and Thailand – is meant not only for Asean connectivity, but also geopolitical purposes.

However, Thailand still has the time to study this matter thoroughly as the memorandum of understanding will be valid for five years after signing, which means it has until December 2019.

There really is no need to hasten the project unless it is too much of a priority or if we have enough money to go ahead with it.

If it is Asean connectivity that we are aiming for, then we are still able to connect with our neighbours as most of them run a 1-metre gauge railway. Plus, Thailand is also improving the existing railway to dual-track from the current single-track set-up.

The government may have made a mistake by deciding to adopt the EPC (engineering, procurement and construction) deal or maybe it is afraid that some may oppose Chinese ownership when discussing the SPV at the early stages of negotiation.

In addition, the unclear purpose of what exactly the railway will be used for — passengers or cargo — has made the project more costly than the original estimate of Bt400 billion. The new estimate is about Bt530 billion.

This may have also led to the project’s designers to opt for speeds of 160-180 kilometre per hour. But, an industry expert has said this speed is made-to-order technology, which is not available on store shelves.

Therefore, looking at the deal in detail, the government has to do its best in further negotiations and ensure public interest is maintained as much as possible.

Since unveiling its first charter draft on January 26, the CDC has been inundated with recommendations from various sectors, including the forums it is organising in all regions.

Yesterday saw the third forum opened for representatives from the Central and the Eastern regions, while the South will get its latest forum next weekend. Principal agencies including the Cabinet must deliver their recommendations by Monday.

CDC spokesman Chartchai na Chiangmai said the panel had received numerous comments and recommendations from the people-based forums, and it has tried to forge a basis for consideration of the proposals so as not leave any out.

Result of referendum on draft constitution won’t affect poll schedule: Wissanu

DEPUTY PRIME Minister Wissanu Krea-ngam reaffirmed yesterday that the next general election would be held next year regardless of the solution adopted if the charter draft is rejected in the referendum.

Wissanu said in order to highlight the significance of reform, the government wanted the Constitution Drafting Commission (CDC) to make provisions on reform a separate chapter rather than merely provisional clauses as was the case in the first charter draft presented by the Meechai Ruchuphan-led CDC.

Asked if the government agreed with other CDC proposals that have met with public resistance, such as for a non-elected PM, Wissanu said the fact that the government had said nothing did not signify it agreed.

Wissanu said it would not be advisable to reveal right now the government’s solution if the charter draft is rejected since that would bring negative consequences. “It would be like giving the public two choices before they make a decision in the referendum – that if they do not take this, they will get that,” he said.

One solution that’s been suggested in case the charter is rejected by a public vote is for the government to pick either the 1997 or the 2007 charter and brush it up for promulgation. Another solution offered by critics of the current draft is to amend the 2014 interim charter.

CDC chairman Meechai yesterday urged critics to read the entire draft and see that it covers all the important issues and aims to tackle the country’s key problems.

He also said the CDC would carefully study suggestions made on its first draft and then make necessary revisions to rectify any flaws or weakness.

The chief charter drafter reiterated that in order to tackle the problem of corruption, the new constitution would ban public-office holders convicted of graft from gaining political power for the rest of their lives.

“The CDC has come up with a mechanism of scrutiny that starts early and continues until elected persons assume office,” he told a seminar on the new charter draft at Parliament.

He also said that some politicians had attempted to distort the content of the draft constitution by, for instance, claiming that government ministers would be restricted in performing their duties.

“This allegation is untrue. The mechanism set in the constitution aims to ensure discipline for government. It does not obstruct government policies as alleged,” Meechai said.

Meanwhile, spokesman for the National Council for Peace and Order, Colonel Winthai Suvari, yesterday urged certain politicians not to use the draft constitution to serve their political motives.

He said it appeared that these politicians were using rhetoric to provoke their supporters in the same way as they did while leading street protests. He urged them to avoid causing confusion for people in society.

“They should better suggest what should be done to improve the draft constitution and where to make revisions. It seems their main goal is to have people vote down the draft,” the spokesman said.

Winthai said the issues of concern raised by those politicians, including red-shirt leader and Pheu Thai Party politician Jatuporn Prompan, had been clearly explained by the CDC on many occasions.

DEFENCE Minister Prawit Wongsuwan rejected reports that he was discussing the purchase of tanks with Nikolai Platonovich, the secretary of Russia’s Security Council.

Prawit, who is also a deputy PM, and Platonovich met at the Defence Ministry yesterday, at a forum entitled “Thailand-Russia Joint Working Group on Security Consultation”, to discuss economic and security cooperation at regional and international levels – including cooperation on combating crime, drugs, terrorism, piracy and cyber crime.

The meeting was held ahead of a visit to Russia by Prawit and Deputy PM Somkid Jatusripitak, scheduled for February 23-27. Both ministers are expected to push for concrete achievements in bilateral cooperation between the two countries.

Prawit said that at the meeting, Thailand offered to sell agricultural produce, while Russia offered equipment to prevent disaster such as planes used to douse forest fires and mechanical tools.

He said the two countries did not discuss anything on military cooperation, just how to boost security, as a growing number of Russians live in Thailand.

He insisted there was no talk about buying tanks, as rumoured.

Prawit went on to explain that during his visit to Russia, he aims to negotiate an exchange of armaments and discuss the two country’s economic problems.

THE PATHUM Wan District Court yesterday acquitted Sgt-Major 1st class Apichart Pongsaawt over charges he had violated the National Council for Peace and Order (NCPO)’s order banning all political gatherings.

The prosecution pointed out that the NCPO had imposed the ban after a coup led by General PrayutChan-o-cha had ousted the Yingluck Shinawatra government on May 22, 2014. Apichart was charged with instigating others to cause turmoil by joining 500 protesters who gathered at Bangkok Art and Culture Centre and held up placards that read “Not yielding to illegal power”.

The defendant denied the charges, saying he had left work on May 23, 2014 at 4.30pm and was heading towards the Bangkok Art and Culture Centre when he received a Facebook message urging him to join the gathering there.

He said that while waiting on the skywalk linking the BTS station with the arts centre, he lifted a placard with a message protesting the coup. About half an hour later five soldiers arrived at the BTS station and escorted him away without explaining what charges might be pressed against him.

Apichart said he was exercising his lawful right to express disapproval of the coup, and had no intention of creating turmoil.

The court acquitted Apichart on grounds that the Crime Suppression Commission did not have the authority to investigate a criminal case in Pathum Wan district, and hence the prosecutors were not authorised to file a lawsuit against Apichart.

THE NATIONAL Legislative Assembly yesterday approved a bill that seeks to replace the outdated nuclear act. The bill proposed by the Science Ministry was approved with 189 votes. Two NLA members abstained.

The NLA set up a panel of 15 members to vet the bill before sending it back to the lawmakers for the second and third readings.

Science Minister Pichet Durongkaveroj told the NLA that the 1961 Atoms for Peace Act had become outdated and was not the best way to ensure safety for the people so should be replaced by the new nuclear draft legislation.

Pichet said the bill would protect the people and environment against dangers from the use of nuclear power in line with international standards.

The new legislation stipulates the formation of a committee, chaired by the prime minister, in charge of supervising the use of nuclear power as well as radiating devices and radioactive materials.

The bill would not cover foreign vehicles and foreign military and law enforcement apparatus.

Washington will not pressure Asean states to join TPP PACT; no priority on rights issues.

THE UNITED STATES will not single out any Asean countries over any controversial issue relating to freedom of expression and other human rights problems like trafficking when US President Barack Obama meets with Southeast Asian leaders at the inaugural US-Asean summit next week, a US diplomat said yesterday.

Prime Minister Prayut Chan-o-cha is scheduled to leave Bangkok on Sunday for California’s Rancho Mirage to attend the two-day summit that starts on Monday.

International human rights groups called on Obama to address freedom of expression and human rights issues with the Asean leaders, especially those from Thailand, Cambodia, Malaysia and Myanmar.

“This is about the collective. It is not an opportunity for unnecessary addresses of bilateral issues,” said W Patrick Murphy, deputy chief of mission of the US embassy in Bangkok. “It is really about the relations between the US and the entire Asean, comprising the 10 countries plus the AseanSecretariat.

“It is not the objective of the gathering [to probe these issues]. Some issues might come up during the meeting. But the intention of the meeting is engagement between the president and his 10 counterparts and the Asean Secretary General.

Murphy said with regards to human rights, Obama was expected to collectively speak to the Aseanleaders about good governance, respecting civil liberties and the rule of law.

“That’s important to the US and the region,” he said. “We have seen advances [in these areas in Asean] and we’ve seen challenges. But the intention is not to single out or address specific issues of individual countries.

“When leaders arrive, they will be greeted by President Obama in Sunnylands, and of course there will be a lot of interaction during the two-day meeting.”

The government’s deputy spokesman, Weerachon Sukhonthapatipak, said: “The prime minister emphasised the key principle for its relations with foreign countries – that Thailand has dignity and integrity. We are a responsible member of Asean and the international community. As a member of the group, we have to have constructive roles to promote relations and cooperation between Aseanand allies.”

Murphy said at the summit Washington would highlight two key messages – the continuation of the Obama administration’s Asia rebalancing policy, and the importance of Southeast Asia to the US.

He said the US and Asean entered into a strategic partnership last November, and this was the first opportunity for their heads of state to meet as well as it being the first Asean summit since its full implementation at the end of last year.

“We feel part of the region, and Southeast Asia is a linchpin for our engagement with all of the Asia Pacific region,” he said. “We are the first dialogue partner of Asean to have a resident ambassador to the Asean Secretariat in Jakarta.

“We are a member of the East Asia summit, our president comes to Southeast Asia every year, not to mention other members of the cabinet.”

The summit will be divided into two parts. Economic matters will be discussed on Monday while Tuesday will be devoted to security cooperations including for maritime, Murphy said

President Obama also plans to touch on innovation and entrepreneurship, he said.

The Trans-Pacific Partnership, a comprehensive free-trade scheme which four Asean members, Brunei, Malaysia, Singapore and Vietnam have already joined, will be discussed, he said.

“There will be opportunities to talk about the TPP and its impact on the region but not exclusively for those who are members,” he said. “We heard some Asean countries are interested, and the president might entertain that kind of interest.

“But we are not asking any non-members to join. We have simply provided information such as about the draft agreements and opportunities.”

Many US cabinet members, such as the secretaries of trade and the treasury, will meet with anyAsean member interested in joining the TPP scheme, he said.

On the security front, Murphy said the leaders would discuss broad issues such as terrorism and collective security in the region.

The hot topic of the South China Sea, where many Asean members are at loggerheads with China in territorial disputes, could also come up, he said.

The US has a consistent stance on calling for freedom of navigation, finding peaceful solutions to problems and respect for international laws and principles, he said.

“Again for the US, we don’t make any claims and we don’t support any particular claims of one over the other. We are about principles,” he said.

Yingluck responsible for Bt250 billion in damages in rice pledging scheme: panel

A FACT-FINDING panel probing civil liability of the previous government’s rice-pledging programme has held former prime minister Yingluck Shinawatra responsible for an estimated Bt250 billion in damage caused to the state coffers, according to sources at the Finance Ministry.

The ministry’s Comptroller-General’s Department played a key role in probing the civil-liability case against Yingluck. A fact-finding panel was set up by Prime Minister Prayut Chan-o-cha and chaired by Jirachai Moontongroy, deputy permanent secretary to the PM’s Office.

The Jirachai panel’s report indicates that Yingluck was negligent and should be held accountable for significant financial damage even though farmers benefited from the rice-pledging scheme during her tenure.

Jirachai pointed to three major mistakes in the rice-pledging scheme. First, the policy allowed farmers to pledge their rice with no limits on the quantity at a price much higher than being offered by the market. Second, there were fake government-to-government rice deals. Third, the Yingluck government failed to call a halt to the scheme despite repeated warnings from the anti-graft agency.

The report said the previous government spent a total of Bt990 billion on the farmer-subsidy programme until May 2014. After it was found that the state lost a total of Bt510 billion in the scheme, which saw rice purchased from farmers for up to Bt15,000 a tonne, well over the prevailing market price of only Bt9,000 at that time.

The programme was widely popular among farmers, resulting in an expansion of rice-farming areas and output, but the government could only sell a small amount of rice, resulting in heavy losses as well as other costs, including expenses for storage.

Sources said Yingluck in her capacity as prime minister and chairwoman of the National Rice Policy Committee was found to be careless in executing the policy, thus causing damage to the state.

However, the panel said it was unfair to hold her accountable for the entire Bt510 billion in losses since farmers also gained from the huge difference between market and pledging prices.

The report said every government that imposes price-support policies for agricultural products faces losses, so it was necessary to deduct operating costs, interest rates, plus farmers’ benefits.

“In this case, we found that the actual damage caused by negligence is around Bt250 billion,” said a source, adding that the report shows Yingluck did not try adequately to prevent the damage to the state, even though there were written warnings from the National Anti-Corruption Commission, the Office of the Auditor-General, the Finance Ministry and academics while the government was executing the policy.

Meanwhile, Pheu Thai Party’s deputy secretary-general Chavalit Vichayasut said the justice process on the rice-pledging case accusing Yingluck of wrongdoing was not yet complete. So, officials should exercise caution on the latest report concerning civil liability.

The civil-liability case is separate from the criminal case that is still under consideration by the Supreme Court on the criminal offence of political office holders.

Chavalit said there should be neither judgement nor opinion on this case prior to the Supreme Court’s verdict.

Nuttawut Saikuar, a leader of the United Front for Democracy against Dictatorship, which was allied with the Yingluck government, said the rice scheme was implemented in a way that benefited farmers the most in history, so allegations of wrongdoing by the former PM while implementing this policy was doubtful.

He said the Prayut government’s rubber-price scheme was similar and there would be state losses from buying rubber sheets from planters at a price higher than the prevailing market price.

Prime Minister Prayut Chan-o-cha gave an cold shoulder to a troop of reporters at Government House as he arrived for a meeting yesterday.

Before attending the annual internal security meeting in the morning, he encountered the reporters, who greeted him a “wai” of respect. Prayut returned the gesture, but remained silent and stony-faced before walking past them to the meeting room.

The Premier later told the meeting that people may or may not understand his recent bouts of anger, but he had been trying his best to curb his emotional expressions.

“Soldiers are hot tempered, but once addressed, we are always ready to improve [our responses],” he said.

PM Prayut has lost his temper in public while giving press interviews on a number of occasions, and last Tuesday’s outburst exceeded the level of his previous anger.

He later apologised for losing his temper and scolding journalists through his spokesman Sansern Kaewkamnerd, who said the premier was under pressure as he had been left to “walk alone”.

“The prime minister asked me to convey to media and [others] that he regretted his outburst on Tuesday,” Sansern said. He was also worried [about public sentiment], but we should understand that he is working under pressure due to high expectations of the people.”

One of the prime minister’s New Year resolutions was to try to be a “good guy” – at least in the eyes of the mass media – by avoiding hot-tempered exchanges with critical reporters.

That resolution appeared to have been broken when the PM – described by reporters as “furious” – was asked about the draft charter and the election road map at Tuesday’s press briefing.

ARMY CHIEF General Teerachai Nakwanich yesterday defended the move to have Thai Reserve Officers and Training Corps Students explain charter draft content to the public and assured it was not aimed at influencing their vote in a public referendum.

Teerachai told a meeting of the Internal Security Operations Command (Isoc) that Prime MinisterPrayut Chan-o-cha wanted him to explain about the role of the students in educating the public about the significance of a referendum on the charter draft.

The students also explain to the people about reform content in the charter draft.

Questions raised by the public would be answered during the programme “Decipher the Charter”.

The students have been doing the fieldwork for two months and are following the regulations on a public referendum, he said. “We know what we are doing. They are not going to stand in front of polling booths on the voting date. We just want the people to exercise their voting right as much as possible regardless of whether they want to vote No, or Yes,” he said. Isoc would also seek cooperation from local leaders like kamnans and village heads to explain the significance and impact of the charter draft on the people.
