Malaysia’s top court ordered former prime minister Najib Razak to begin a 12-year prison sentence on Tuesday after upholding a guilty conviction on charges related to a multi-billion dollar graft scandal at state fund 1Malaysia Development Berhad (1MDB).

The Federal Court ruling caps the stunning downfall of Najib, who until four years ago governed Malaysia with an iron grip and suppressed local investigations of the 1MDB scandal that has implicated financial institutions and high-ranking officials worldwide.

Having played golf with US presidents Donald Trump and Barack Obama, Najib will now count convicted murderers and drug traffickers as neighbours.

Residents of Putrajaya, where the court announced its verdict, were pleased with the result.

“From the bottom of my heart, I am happy justice is served and he deserved it,” one resident, Fardlan, told Reuters.

Najib, 69, was found guilty by a lower court in July 2020 of criminal breach of trust, abuse of power, and money laundering for illegally receiving about $10 million from SRC International, a former unit of 1MDB. He had been out on bail and pending appeals.

The former premier, who pleaded not guilty, was sentenced to 12 years in jail and a 210 million ringgit ($46.84 million) fine.

Marina Ibrahim, the resident of Putrajaya, said she thought the sentencing was “well deserved”.

Chief Justice Tengku Maimun Tuan Mat said the court unanimously dismissed Najib’s appeals and that the lower courts’ conviction was safe.

Knocking back Najib’s final appeal, the country’s top court also denied his request for a stay of sentence.

Najib, dressed impeccably in a dark suit and grey tie, was seated in the dock as the verdict was read out. His wife, Rosmah Mansor, and three children were seated behind him.

Prosecutors have said some $4.5 billion was stolen from 1MDB – co-founded by Najib during his first year as prime minister in 2009. Investigators say they had traced more than $1 billion of 1MDB money to accounts linked to Najib.

A lawyer for Najib expressed his disappointment after Malaysia’s Federal Court upheld a verdict. 

“We’re very sad because we lost the appeal… (only) the Almighty alone can dispense perfect justice,” said Hisyam Teh Poh Teik, who is head of Najib’s legal team.

Najib said that he was not given a fair trial in his final appeal, hours before Malaysia’s top court upholds a guilty verdict against him.

Speaking to supporters and members of the media outside the Federal Court, Najib thanked them and said everything he proposed to the court was rejected. “I did not get my justice and I didn’t get a fair trial based on its principles,” the ex-prime minister said.

A day before the final verdict, Najib said in a Facebook post that he was overwhelmed and felt betrayed and alone.

“There are times when we feel overwhelmed by tests and trials. With slander and persecution, sincerity is rewarded with betrayal. Sometimes we feel we are alone,” he said.

He left the court in a black vehicle with a police escort shortly after he was ordered to begin a 12-year prison sentence. He arrived at the Kajang Prison at around 6.10 pm  

Police are keeping a close eye on the current situation at the prison.

Members of the media have been barred from entering the Kajang Prison complex.

Vehicles were also seen making u-turns. A crowd had congregated soon after news broke that Najib was sent to the Kajang Prison.

It marked a stunning turn of events for a leader who held tightly on to power at the peak of accusations over 1MDB. 

Najib had started his final attempt on August 15 to set aside his conviction in a corruption case linked to the 1MDB scandal. He had replaced his legal team just three weeks prior.

But his strategies backfired with the court declined to provide more time for his lawyers to prepare.

“I am not ashamed to say, I was desperate, as would (be) any litigant in my predicament,” Najib said in a statement last week, explaining his move to change lawyers.

The 1MDB case, which has also implicated officials and financial institutions around the world and US Department of Justice has described as its biggest kleptocracy investigation, has since been widely seen as a test of the nation’s resolve to stamp out corruption and which could have big political implications.

Protests erupted when allegations arose in 2015 following a report that claimed investigators looking into the firm found $681 million had been transferred to Najib’s personal bank account.

Following the allegations, Malaysia’s attorney-general cleared Najib of the offences, stating the $681 million was a gift from the royal family in Saudi Arabia.

Protests continued, and after Najib was ousted as Prime Minister following a general election in May 2018. 

Najib tried to leave the country soon afterwards, but he was stopped, arrested briefly and Malaysians did not expect to see involving the son of the nation’s well-respected second prime minister, Abdul Razak Hussein.

Police raided Najib’s private residence, seizing 284 boxes containing designer handbags and dozens of bags filled with cash and jewellery amounting to more than $245 million.

Since then, the former premier has spent the better part of his time in court, defending himself against a total of 42 charges. He has maintained his innocence all along and said he was misled by 1MDB officials.

The dismissal of his final appeal on Tuesday involved a 2020 conviction by a lower court for criminal breach of trust, abuse of power and money laundering for illegally receiving about $10 million from a former unit of 1MDB.

The scandal has also ensnared Hollywood stars such as Oscar-winner Leonardo DiCaprio, whose charitable foundations received donations from 1MDB.

A Hollywood production company was accused in a U.S. civil lawsuit of using $100 million that prosecutors said had been diverted from 1MDB to finance DiCaprio’s 2013 film “The Wolf of Wall Street”, in which DiCaprio starred.

In October 2020, Goldman Sachs and its Malaysia subsidiary also pleaded guilty to U.S. Department of Justice charges over its role in Malaysia’s 1MDB corruption scandal, paying nearly $3 billion to settle the charges over its role in the scandal.

Najib could now apply for a review of the Federal Court decision, though such applications are rarely successful.

He can also seek a royal pardon. If successful, he could be released without serving the full 12-year term.

The conviction means Najib will lose his parliamentary seat and cannot contest elections. He also faces several other 1MDB trials.

Najib was groomed for high office from his political debut, aged 23.

Until recently, he was the youngest person elected to parliament. The British-educated son of nobility was elected as premier in 2009.

Najib struck a reformist tone, pushing for liberal economic policies and repealing colonial-era security laws in a bid to shed the perception of a government unwilling to brook dissent.

But the disenchantment of Malaysia’s ethnic minorities in a 2013 election prompted Najib to roll back his reform pledges in the face of anger over a perceived loss of long-held economic privileges by the majority ethnic Malays.

Majority Muslim Malays form 60% of a population of about 32 million, with the rest mostly made up of ethnic Chinese and ethnic Indians.

In 2015, the first signs of scandal began to surface at 1MDB, prompting Najib to go after critics decisively.

It took a historic election victory by the opposition in 2018 for Malaysia to reopen 1MDB investigations that eventually led to dozens of charges against Najib.

Najib remains popular in some quarters, including his UMNO party, which came back to power last year amid political turmoil.

His regular jabs at the opposition and lighthearted updates on Facebook have drawn more than 4 million followers, making him Malaysia’s most popular politician on social media.

The United States has promised to help Thai and Asean SMEs get back on their feet after the Covid-19 crisis, Thailand’s Department of Trade Negotiations (DTN) said on Tuesday.

DTN director-general Oramon Sapthaweetham said Washington had vowed to deliver the aid under the Asean-US Trade and Investment Framework Agreement (TIFA) signed last year.

“For 2022-2023, the United States has promised to provide technical assistance to Asean members, especially for online business, upgrading labour skills, environmental standards, and other projects that facilitate international trade,” she said.

Washington would focus on helping small and medium enterprises suffering impacts from Covid-19, she added. “Aid will come in the form of an upgrade for the Asean SME Academy to train and assist operators.”

Oramon added that under the Asean-US TIFA, Asean countries agreed to promote a single-point e-customs network connected to the US network for seamless international customs operations. Asean members also agreed to facilitate the protection of intellectual property, labour rights and environmental standards to forge a long-term trade partnership with the US.

The DTN is also preparing for Asean-Canada Free Trade Agreement (ACAFTA) talks from August 29-September 1, by summarising agenda points from the previous 16 meetings ahead of a final agreement.

The ACAFTA is expected to follow the Asean-Canada Trade and Investment Framework of 2021-2025, with a focus on promoting sustainable economic growth in both regions in the post-Covid era through technical cooperation, promotion of digital economy, and knowledge exchange in trade, services, labour, and environmental management.

Drought dries up China’s largest freshwater lake

State-run broadcaster CCTV on Tuesday showed comparison satellite images of the drought affecting Poyang lake, China’s largest freshwater lake, in Jiangxi province, in April and in August.

In April, Poyang lake covers an area of nearly 4,000 square kilometres, according to state television CCTV. It now covers less than 600 square kilometres, according to the report.

Poyang Lake, located in one of the Yangtze river’s flood plains and described as China’s “kidney” because of the role it plays in regulating water supplies, is now 67% smaller than the average over the last 10 years, CCTV reported.

China remains on a heat “red alert” for the 12th day on Tuesday, temperatures are expected to fall in parts of central China by Wednesday, and in Sichuan and Chongqing from Aug. 29, the National Meteorological Center said on its official Weibo channel.

State forecasters said China’s heatwave, which has lasted more than two months, was about to hit a “turning point,” with a cold front looming from the west and a typhoon approaching in the southeast.

Analysts say the Yuan Wang 5 is among a group of Chinese ships that monitor satellite, rocket and intercontinental ballistic missile launches.

India, Sri Lanka’s northern neighbour, fears China could use the port as a military base.

Sri Lanka, facing its worst economic crisis in decades and in need of financial support from both China and India, had delayed the ship’s arrival after India raised its concerns but gave in to Chinese demands later.

The ship has now left the southern Sri Lankan port, said the Hambantota International Port Group, a partnership between Sri Lanka’s government and China Merchants Port Holdings.

The ship’s next destination was not immediately known.

The Pentagon says the Yuan Wang ships are operated by the Strategic Support Force of the People’s Liberation Army.

Yuan Wang 5 Captain Zhang Hongwang said last week that the ship’s visit would “deepen the exchange between China and Sri Lanka in the field of space science and technology and promote the common progress of the space industry of the two countries.”

China says the Hambantota port, leased by China Merchants in 2017 for 99 years, is a key part of its Belt and Road initiative linking infrastructure projects in various countries.

Brazil to display heart of monarch who declared independence in 1822

The heart of Portuguese monarch Dom Pedro I, who declared Brazilian independence from Portugal 200 years ago and was named “emperor” of Brazil, arrived from Portugal on Monday and will be put on display as part of independence anniversary celebrations.

The heart has been kept in an urn with formaldehyde in the Portuguese city of Porto since Pedro’s death in 1834 in Portugal at the age of 35.

The Portuguese government agreed to loan the heart to Brazil for three weeks for the bicentennial celebration. The Brazilian air force flew it to Brasilia, where it was received on Monday by the country’s defence minister.

Porto Mayor Rui Moreira said the arrival of the monarch’s heart to Brazil represented a great joy for the Portuguese people.

Far-right President Jair Bolsonaro will receive the relic on Tuesday (August 22) at the presidential palace with military honours and a gun salute, before putting it on public display at the Foreign Ministry through Brazil’s Independence Day on Sept. 7.

Pedro’s declaration of independence from Portugal, which is acclaimed by Brazilian nationalists as the birth of their country, was an act of defiance against his father, Portuguese King Joao VI.

The Portuguese king’s family was escorted to safety in Brazil by the British Navy in 1807 before Napoleon’s forces invaded Portugal. On returning to Lisbon in 1821, he left his son Pedro as prince regent of Brazil.

Pedro’s heart was separated in 1834 and kept in a church in Porto according to his last wishes. His remains were donated to Brazil in 1972 for the 150th commemoration of Brazilian independence and are kept in a museum in Sao Paulo.

US officials on Monday discouraged former American pro basketball player Dennis Rodman’s reported plan to travel to Russia to seek the release of American basketball star Brittney Griner.

Griner, 31, is a two-time Olympic champion and star player in the Women’s National Basketball Association (WBNA). Earlier this month she was convicted by a Russian court and given a nine-year sentence on drug charges.

U.S. President Joe Biden has condemned the verdict, calling it “unacceptable.”

The United States has offered to exchange her for Viktor Bout, a Russian arms dealer serving a 25-year prison sentence in the United States.

Rodman told NBC News on Saturday that he plans to visit Russia to seek Griner’s release.

State Department spokesman Ned Price said if Rodman travels to Russia he would not be on behalf of the U.S. government and warned that his trip could “complicate” and “hinder” ongoing diplomatic efforts to secure the release of Griner and former U.S. Marine Paul Whelan who was sentenced in 2020 to 16 years in jail for spying.

The State Department has issued a travel advisory warning Americans not to travel to Russia.

Rodman has sought to inject himself into international diplomacy in the past. He is one of a handful of westerners to have met North Korean head of state Kim Jong Un.

Responding to a report of a shooting at around 1:45 PM (17.45 GMT), police found two people at an upscale condominium building near Colony Square, an office and shopping complex in Atlanta’s Midtown area. One of them died while the other was taken to a hospital, police said.

While at the first location, officers received another call about a shooting less than a mile to the southeast at a high-rise office building, where police found the third victim.

That person also appeared to have been shot and later died at a hospital, police said.

Officers were investigating the connection between the two locations. Initial information indicated that a female suspect was responsible for both incidents, police said.

Before the suspect was located at Hartsfield-Jackson Atlanta International Airport and taken into custody, police blocked off multiple blocks in Midtown, and people in some buildings were directed to shelter in place.

“I believe this is the right thing to do, and something that most Singaporeans will now accept,” Prime Minister Lee Hsien Loong said in the annual national day rally speech, adding the government will repeal Section 377A of the penal code, a colonial-era law that criminalizes sex between men.

“Even as we repeal Section 377A, we will uphold and safeguard the institution of marriage… Under the law, only marriages between one man and one woman are recognized in Singapore,” Lee added.

Singapore residents on Monday welcomed Prime Minister Lee Hsien Loong’s plan to decriminalise sex between men, even though he had no plans to change the legal definition of marriage as being between a man and a woman.

“Very outdated law. I mean, repealing it sounds like it makes a lot of sense right now,” said Lim, a 48-year-old local resident who only provided his surname. Another resident said the legal adjustment would be a “timely” move and a “well-struck balance”.

Lee’s announcement was also welcomed by LGBTQ groups who said in a joint statement they were “relieved”. But they also expressed concern that ruling out same-sex marriage would help to perpetuate discrimination.

It was unclear when exactly Section 377A of Singapore’s penal code, a colonial-era law that criminalises sex between men, would be repealed. Under the law, offenders can be jailed for up to two years, but it is not currently actively enforced.

Security forces have ended a siege by al Qaeda-linked militants at a hotel in Somalia’s capital in which more than 20 people were killed and dozens injured, authorities said on Sunday.

Dozens of people who had been taken hostage in the stand-off at the Hayat Hotel in Mogadishu were freed.

Elite armed forces battled the militants for 30 hours from Friday evening after the attackers blasted and shot their way into the hotel, which is popular with lawmakers and other government officials.

“We have confirmed so far 21 dead people and 117 others injured,” Ali Haji, the minister for health, told national broadcaster SNTV.

Three attackers were shot dead during the military operation to end the siege, said Hassan, a police captain who only gave one name.

A fourth one was shot dead in the area on Sunday morning as he attempted to melt into the civilian population, Hassan said, adding that the exact number of attackers was still unclear.

The al Qaeda-linked al Shabaab group, which has been fighting to topple the government in the Horn of Africa country for more than a decade, claimed responsibility for the attack.

Friday’s attack at the Hayat was the first major incident since President Hassan Sheikh Mohamud took office in May.

The attackers shot and killed civilians who fled towards the wall of the hotel compound and its blown-up gate after they struck, said a police captain who gave only the name Ahmed, adding that they killed 10 security personnel with firearms and grenades.

Darya Dugina, daughter of prominent ideologue Alexander Dugin, was killed after a suspected explosive device detonated on the Toyota Land Cruiser she was travelling in, investigators from the Moscow region said in a statement.

Russia’s TASS state news agency quoted Andrei Krasnov, someone who knew Dugina, as saying the vehicle belonged to her father and that he was probably the intended target.

Father and daughter had been attending a festival outside Moscow and Dugin had decided to switch cars at the last minute, Russian government newspaper Rossiiskaya Gazeta reported.

TV footage accompanying the statement showed investigators collecting debris and fragments from the spot where the explosion happened.

Investigators, who described Darya Dugina as a journalist and political expert, said they had opened a murder case and would be carrying out forensic examinations to try to determine exactly what had happened.

They said they were considering “all versions” when it came to working out who was responsible for the crime.

Alexander Dugin, Darya’s father, has long advocated the unification of Russian-speaking and other territories in a vast new Russian empire.

He wants that empire to include Ukraine where Russian forces are currently carrying out what Moscow calls a “special military operation” to demilitarize Ukraine.

The influence of Dugin, who is on a U.S. sanctions list, over Russian President Vladimir Putin has been a subject of speculation, with some Russian watchers asserting that his sway is significant and others calling it minimal.

Darya Dugina, who also went by the surname Platonova and was reported by Russian state media to be 30 years old, broadly supported her father’s ideas and appeared on state TV in her own right to offer support for Russia’s actions in Ukraine.

In a statement in March, the U.S. Treasury said Dugina, the chief editor of the United World International website, which has suggested Ukraine would “perish” if admitted to the NATO military alliance, had been put on a U.S. sanctions list.
