THE NATIONAL Anti-Corruption Commission is still considering additional evidence about violence during the crackdown on yellow-shirt protesters in 2008 and has not reached a conclusion yet on whether it will withdraw the case from court, NACC chairman Pol General Watcharapol Prasarnrajkit said yesterday.

Protesters with the People’s Alliance for Democracy were violently dispersed from outside Parliament in October 2008, leading to a charge by the NACC against the then prime minister and his deputy, plus two senior police chiefs, for alleged malfeasance. Two people were killed and more than 300 injured, including police.

Those charged were former prime minister Somchai Wongsawat, General Chavalit Yongchaiyudh, former National Police chief Pol General Patcharawat Wongsuwan and ex-Bangkok police chief Pol Lt-General Suchart Muankaew.

The case is with the Supreme Court’s Criminal Division for Political Office Holders.

The defendants recently submitted additional evidence to the NACC, asking it to withdraw the court case.

Watcharapol confirmed that the anti-graft agency was still considering the evidence, and had yet to reach any conclusion.

One of the defendants, Patcharawat, is Deputy Prime Minister Prawit Wongsuwan’s brother. The deputy PM reportedly backed Watcharapol as the new NACC chairman, leading to speculation by some observers that nepotism could be at play.

Anti-corruption activist Veera Somkwamkid has threatened to sue the NACC if it drops the case.

‘Critical case’

Watcharapol said the NACC was authorised to consider whether the case should be withdrawn from the court, but he said it would depend on the new evidence – if it carries enough weight for theNACC to consider doing that.

Watcharapol said the NACC had assigned officials to study the evidence and they would report back to the commission.

“We are fully aware that this case is critical and we must be able to answer to the public on whether to proceed with the case. So we must pursue it with utmost righteousness and professionalism,” the NACC chief said.

Watcharapol said the defendants could also file a petition to ask the court to withdraw the case, but that would be the court’s business – it had nothing to do with the NACC proceedings, as they were different institutions.

The NACC, he said, would pursue the case after a lawful legal assessment.

“Considering the legal aspect, we can withdraw the case, but with what reasons is rather a bigger issue that we need to consider carefully,” he said.

If the govt wants a multiplier effect, why delay tax changes?

BURNING ISSUE

Thai taxpayers were no doubt delighted on Tuesday when the government announced a revised taxation structure featuring more and larger deductions and allowances.

But those in a hurry to spend their future windfalls are advised to show caution.

The government economics team led by Deputy Prime Minister Somkid Jatrusipitak has been keen to employ any tactic that might spur domestic spending.

High-income earners – those with annual income of between Bt4 million and Bt5 million after deductions and allowances – should benefit most under the new structure.

Apart from a deduction of Bt100,000 and allowance of Bt60,000 (up from Bt90,000 and Bt30,000 currently), this bracket enjoys a 5-per-cent cut, to 30 per cent tax.

Currently, those who earn between Bt2 million and Bt4 million a year are subject to 30-per-cent tax. Above Bt4 million, tax rises to the maximum rate of 35 per cent. But under the new structure, those who earn between Bt2 million and Bt5 million will be subject to the 30-per-cent rate. Meanwhile the 35-per-cent rate will only apply to those who earn more than Bt5 million.

In short, if you earn Bt5.16 million a year, you can save around Bt130,000 annually – a rise of Bt74,500. If you earn taxable income not exceeding Bt300,000 a year, you will be free from tax, although that only represents a modest saving of Bt3,600.

If that all sounds good, we shouldn’t forget that the new rates, deductions and allowances won’t be launched until the 2017 tax year, meaning that tax claims won’t be delivered until 2018.

Many are wondering why the government isn’t employing the new tax structure this year, though officials have explained that the 2017 date will ensure a balance is maintained between public revenue and spending.

Nevertheless, critics view the new rates as symptomatic of a lack of economic direction and a last-ditch bid to boost consumer sentiment in the hope of triggering a multiplier effect and boosting the economy.

Over the Songkran holiday, the government launched a campaign of tax benefits on food and tourism-related products priced up to Bt15,000, with a similar aim of boosting consumer spending. Authorities were happy at the success of the campaign, but ignored the fact that many of the shoppers who flocked to take advantage of the tax-back bonanza earned incomes short of the level required to pay tax.

Meanwhile high-income earners form only a small proportion of the total 10 million taxpayers but contribute most in tax payment.

If the government wants to create a multiplier effect for the economy, it has no need to delay the taxation changes.

Watana freed on bail, barred from political activity

Former Pheu Thai MP Watana Muangsook is escorted to the Bangkok Military Court yesterday as the NCPO requested the court to extend his detention. Watana was later freed on bail.

PHEU THAI Party politician Watana Muangsook yesterday was released on bail of Bt80,000 by the military court on condition that he does not get involved in political provocations and cannot leave the country without court permission.

The National Council for Peace and Order (NCPO) yesterday had sought the military court’s permission to extend Watana’s detention for his alleged violation of an NCPO order.

The politician denied the allegation, saying he had just expressed his opinion on a social network and had not violated any agreement with the NCPO, according to his lawyer Narinpong Jinapak.

Watana is accused of breaking an agreement with the NCPO that he would not carry out political activities, which he had signed for his previous release from detention.

The politician has been detained four times, including the most recent detention, which was justified because he had violated the NCPO Announcement Number 39/2557, according to an NCPO source.

//

The politician has been on a partial hunger strike since being detained on Monday, consuming only coconuts and juice.

He appeared at the Bangkok Military Court yesterday after previously being held at the 9th Infantry Division Headquarters in Kanchanaburi province, to acknowledge the charges against him at the 11th Army Circle in Bangkok.

Previously Watana’s lawyer had said authorities planned to release him next Monday, but authorities appeared to have changed their minds and brought the accused politician to court.

On arrival at the court, Watana was seen wearing the same grey T-shirt he had worn when he was detained. He was escorted by authorities and did not speak to the press.

His lawyer, Narinpong said earlier he would ask the court to release Watana on Bt50,000 bail.

Deputy Prime Minister Prawit Wongsuwan said the court could decide whether to grant him a temporary release.

He added that the military would not be involved because the case was being tried within the judicial system.

But he added: “If Watana stages a new move and the court revokes his bail, he has to go to jail.”

Prawit said officials had taken action against Watana because his actions violated NCPO order and he had already signed an agreement to accept the consequences for the violation.

“We take action not because we want to ‘kill a chicken to scare the monkeys’. It is an action against an individual. There is no need to for him to undergo the NCPO course for ‘Constructive Country Leaders’,” he said, referring to a “training” course drawn up for political opponents.

Prawit also downplayed Watana’s hunger strike. “We do not feel any pressure if he does not eat rice meals. What can we do? May he likes to eat coconut,” he said.

Prawit dismissed a call from Amnesty International for an unconditional release of Watana, saying it was Thailand’s internal affair and the government did not violate human rights. “If we let people like this make moves, the country cannot move forward. The public will be affected, not the NCPO,” he said.

NCPO public relations deputy chief Colonel Piyapong Klinpan said the government had acted fairly by adopting an approach that included both soft and hard measures.

“We mainly negotiated with him. We followed legal steps. Although Watana’s actions seem to be well planned and supporters back his moves, we solve problems diplomatically to prevent ill feelings among Thai people. We are being careful about exercising power,” he said.

He said the government is investigating the parties behind Watana’s actions and who financed him.

Meanwhile, Watana’s daughter Weerada Muangsook recently flew to Hong Kong with her mother for undisclosed reasons, according to Watana’s lawyer Narinpong.

Weerada has filed complaints with both the US Embassy and the EU offices in Bangkok, calling for her father’s release. But Narinpong added that Weerada had no hidden agenda and that she and her mother had made previous plans to travel abroad.

The lawyer also emphasised that Weerada was not supported by any particular group, adding that she had nothing to do with the anti-junta activist group Resistant Citizen.

Resistant Citizen, which has called for the release of Wattana, yesterday announced the cancellation of a symbolic protest at BTS Chong Nonsi station.

However, key member Sirawith Seritiwat said the group would continue to protest against any action by the junta that was viewed as infringing on human rights.

Meanwhile, Democrat Party deputy leader Nipit Intarasombat said Watana’s tactic of applying pressure via the international community was effective because foreign diplomats and Amnesty International have responded to petitions made by Weerada.

“The anti-government group thinks they can spark the world community’s interest by what they did. Students may start hunger strikes and the problem will snowball,” Nipit said.

He added that anti-government forces had also picked the right time to stage a movement, as the country nears a public referendum.

“By international standards, the public should be allowed to express opinions if they agree or disagree. I have warned the government that it must make clear what can be done and what cannot be done. It is still debatable if wearing T-shirts with the message ‘Vote No’ is okay,” he said.

Veera threatens to sue NACC if it drops case on 2008 ‘yellow shirt’ crackdown

ANTI-CORRUPTION activist Veera Somkwamkid has said that he will file a lawsuit against the National Anti-Corruption Commission (NACC) for dereliction of duty if it drops the case against those who were allegedly behind the violent crackdown on “yellow-shirt” protesters in October 2008.

“I will not let this happen because it is illegal. I have warned the NACC that I will take drastic measures. I have completed writing the lawsuit,” he said.

Those involved in the case include former prime minister Somchai Wongsawat, General Chavalit Yongchaiyudh, former National Police chief Pol General Patcharawat Wongsuwan and ex-Bangkok Police chief Pol Lt-General Suchart Muankaew.

The NACC had earlier filed a suit against them at the Supreme Court’s Criminal Division of Political Office Holders for alleged malfeasance over the crackdown on the yellow-shirt People’s Alliance for Democracy. The case is under trial.

“If I file the suit against the NACC, not only the NACC will be in jeopardy, but the National Council for Peace and Order [NCPO] who is behind the move [to drop the case] will also be in the soup. Everybody knows that Deputy PM Prawit Wongsuwan is backing Pol General Watcharapol Prasarnrajkit for the position of NACC chairman so he can help his brother Patcharawat fight this case. If the NACC drops the case, the society will no longer trust the NCPO, which brought down the last government, because it will show them as colluding,” he said.

“If the case is dropped, the justice system will be destroyed. The law will no longer be sacred,” he said.

The NACC is considering withdrawing the case after the defendants filed a petition saying they had new evidence and were asking the anti-graft agency to drop the case.

The NACC met before the Songkran holiday and voted six to one ruling that the agency has the legal right to withdraw the case.

The agency assigned NACC secretary-general Sansern Polajiak to compare the case with the crackdown on the red-shirt movement in 2010. In that case, the NACC dropped a lawsuit against ex-PM Abhisit Vejjajiva, his then-deputy Suthep Thaugsuban and ex-Army chief General Anupong Paochinda.

Veera said the NACC could not compare the two cases because different laws were in effect when the incidents took place. “In 2010, there were laws [on dispersing rallies], but in 2008 no such laws were in place,” he said.

Foreign elections watchdogs preparing for charter referendum

ศาสตร์เกษตรดินปุ๋ย : ขอบคุณแหล่งข้อมูล : หนังสือพิมพ์ The Nation

http://www.nationmultimedia.com/politics/Foreign-elections-watchdogs-preparing-for-charter–30284451.html

INTERNATIONAL election watchdogs have started planning for the deployment of observers for the upcoming referendum on the constitution, with some waiting to see how the authorities will set the rules.

Pongsak Chanon, Asian Network for Free Elections (Anfrel) project coordinator for Thailand, said yesterday that the organisation would assign more than 10 experts to produce analyses and reports on the campaigning and voting situation in the Kingdom. Their action plans should be concluded next week, Pongsak said.

Anfrel’s referendum observation plan has been approved by Election Commissioner Somchai Srisuthiyakorn, Pongsak said.

He suggested the government should allow freer expressions on the constitution draft to truly achieve democracy after the referendum.

Sakul Suesongtham, a People’s Network for Election in Thailand committee member, said the group had thought of assigning local observers for government-organised public forums on the charter draft.

The group has not yet come up with an observation plan on the referendum as it has not heard the observation rules from the authorities yet, Sakul said.

Attasit Pankaew, Thailand Political Base chief researcher, agreed that the rules needed to be devised before interested international watchdogs could make plans.

Attasit, who is also a Thammasat University political science lecturer, commented that it was essential for people to thoroughly understand the complex draft before voting.

Charter drafters and the Election Commission (EC) need to ensure that campaigns on the draft will be free of bias, he added.

Thailand Political Base is supported by the Freidrich Naumann Foundation, a German non-profit organisation that aims to promote knowledge on civil education, democracy and human rights.

Meanwhile, the charter-opposing United Front for Democracy against Dictatorship (UDD) yesterday petitioned the EC, saying it should clarify what is prohibited during the charter campaign. The EC should also allow people to express different views on the charter draft, it said.

The UDD chairman Jatuporn Prompan said the EC should be the sole authority for the referendum rather than the government speaking about what people could and could not do.

EC deputy secretary-general Metha Silaphan said related prohibitions were stated in the referendum bill draft’s Article 62, but Jatuporn argued that the article was obscurely written.

NLA and CDC forums

Interior Minister General Anupong Paochinda said yesterday that nobody was allowed to influence other people’s votes, adding that they were only allowed to explain the draft charter’s contents and encourage others to cast their ballot.

The EC should have a final say on this murky issue, Anupong said, adding that the Constitution Drafting Commission (CDC) would educate its provincial representatives on the charter draft so they could provide information to the general public.

The CDC will brief five representatives from each province from May 14 to 15 before they teach representatives at district levels. Then four district representatives will be assigned to educate each village, the minister said. A total of 300,000 representatives will be in charge of educating and providing copies of the draft charter’s summary to local people, he said.

Meanwhile, National Legislative Assembly (NLA) member Thaweesak Suthakavathin said the NLA was considering holding public forums on the draft to address the drafters’ concerns.

Thaweesak said that separate forums could help prevent confusion between the draft’s main contents and the additional referendum question. The NLA will explain the reason behind its proposed question, while the CDC will explain the draft charter’s content.

FORMER PRIME minister Banharn Silpa-archa was in intensive care at Siriraj Hospital yesterday after suffering an asthma attack.

The veteran politician, 84, who is the patriarch of the Chart Thai Pattana Party, was rushed to hospital in the middle of the night on Wednesday.

His family members attempted to use an inhaler to help him breath but failed.

The dean of Siriraj’s medical faculty, Dr Prasit Wattanapa, said that the politician’s condition was still critical.

He said Banharn needed medication for his heart and for broncho-dilation to regain normal respiration.

“Multiple medications are involved in his treatment, making it difficult to say whether he was conscious or unconscious. He will still need close medical attention,” Prasit said.

Banharn’s colleagues from Chart Thai Pattana, Nikorn Chamnong and Somsak Prissananantakul, said the former prime minister has long suffered from chronic asthma and usually used an inhaler twice a day. The attack was possibly because of the weather change, they added.

They said Banharn was almost fully recovered.

Banharn is popularly known for representing his home province Suphan Buri, leading it to its rapid growth and development.

Many schools and facilities in the province have been named after him and his wife, Jamsai Silapa-archa, such as Banharn Jamsai School.

Thaksin and Prayut

Thaksin and Prayut

Noppadon denies any role by former premier; Prayut says referendum won’t be held if it’s not possible.

PRIME MINISTER Prayut Chan-o-cha yesterday accused fugitive former PM Thaksin Shinawatra of being the mastermind behind recent political moves that have been affecting the current military-led regime.

This is the first time the general has named Thaksin, who has been living in self-exile overseas in order to escape imprisonment at home.

Prayut reacted angrily when asked to state exactly who he thinks is behind the ongoing political moves, such as widespread criticism of the draft charter and protests over the detention of Pheu Thai Party politician Watana Muangsook.

“I just said that someone is plotting and funding this. Foreign lobbyists were hired. Who can be behind all this? It is Thaksin. I could be attacked for saying this,” said Prayut, who also leads the military’s ruling National Council for Peace and Order.

The PM suggested that a television station linked to Thaksin and the red-shirt movement loyal to him were behind the protest led by a small group of activists this week.

He claims the protesters were taken to the protest sites in vehicles provided by the TV station and the red-shirt United Front for Democracy against Dictatorship (UDD).

Despite his physical absence from the field of politics, Thaksin is believed to have maintained influence over Pheu Thai Party, which ruled the country before the military took over in May 2014.

Apart from activists protesting against Watana’s detention, his daughter has petitioned the United Nations, the European Union and the US Embassy in Bangkok, calling on them to determine whether her father’s rights were being violated.

Prayut said yesterday that some people appeared to be doing their best to keep the country in turmoil, which he said could lead to unrest in the run-up to the referendum on the draft charter and also the next general election.

When asked if the referendum would have to be cancelled, Prayut said, “We will not hold it if it is not possible,” noting that before the military coup, political unrest had also caused a planned general election to be cancelled.

“If people start clashing again, we will be back at Square 1 and what we have done will be wasted,” he added. Prayut said it would depend on the general public if they want to allow that, adding that it was not up to his government. “My duty is to enforce the law to maintain peace and order,” he said.

Earlier, the junta had suggested that the recent political moves had been well coordinated and involved people in the same group.

Meanwhile, Thaksin’s spokesman Noppadon Patama yesterday dismissed Prayut‘s allegation that the former leader had hired lobbyists to campaign for foreign governments and organisations to act against Thailand.

Noppadon, a former legal adviser to Thaksin, issued a statement declaring that Thaksin was not behind the protests.

“Thaksin Shinawatra has not employed any lobbyists overseas,” he said. “He is not behind any government in exile.”

‘Small mouse living overseas’

He added that Thaksin “is just a small mouse living his life overseas, so he can’t have any influence on the standpoints of foreign countries and international organisations”.

Noppadon also called for “fair treatment” for Thaksin. “He has never regarded anyone as his enemy. He would like to see the country move forward and for reconciliation to take place and for Thais to become happy. He always loves and has good wishes towards Thailand and the Thai people,”Noppadon said.

In a related development, red-shirt leader Jatuporn Promphan yesterday rejected Prayut‘s allegation that the UDD was behind the recent protests, saying the PM appeared to have obtained inaccurate information regarding this matter. “I can insist that nobody is behind the moves being made by Watana’s daughter and the protesting students,” he said, adding that he had instructed other red-shirt leaders to keep their distance from the activists, otherwise the protesters’ credibility could be undermined.

EU warns over Thai IUU efforts

IUU

THE EUROPEAN Union (EU) warned yesterday that it could ratchet up the pressure on Thailand to get it to tackle illegal fishing, saying that “serious concerns” remain about the country’s willingness to cooperate.

The EU has been cracking down on illegal, unreported and unregulated (IUU) fishing with the threat of import restrictions.

The European Commission is “evaluating progress”, it said yesterday, noting that a meeting with the Thai authorities is due to take place next month, Deutsche Presse-Agentur reported from Brussels.

“The dialogue is proving difficult and there remain serious concerns about the steps taken by Thailand to fight IUU fishing activities,” EU Fisheries Commissioner Karmenu Vella wrote in a statement, adding that “further action … cannot be ruled out”.

“Thailand’s fisheries industry has an inadequate legal framework within effective sanctions that fail to deter, poor monitoring systems, and problematic management,” the commission said. It also warned about human trafficking and slave labour in the Thai fisheries sector, although these issues are not covered by EU rules on illegal fishing activities.

//

Thailand, the world’s third-largest seafood supplier, was warned a year ago that it must do more to crack down on illegal fishing practices or else face EU sanctions.

Deputy premier Prawit Wongsuwan has admitted to some shortcomings in trying to solve the IUU fishing issue as identified by the EU, whose officials yesterday suggested the 28-country grouping will maintain its threat of a Thai seafood import ban.

But Prawit, who heads the government’s multi-agency committee tasked with tackling the problem, said there had been no report issued so far by Virachai Plasai – the Thai ambassador and permanent representative to the United Nations in New York – regarding the prospect that Thailand might get a “red card” from the EU over the issue when it re-evaluated what measures it might impose on the Kingdom shortly.

Prawit said the EU was not satisfied with Thai measures on certain aspects of the effort to solve the IUU problem but the government would continue to implement its actions and report the progress to EU officials.//DEUTSCHE PRESSE-AGENTUR/THE NATION

Prime Minister Prayut Chan-o-cha shows off his badminton skills in a one-on-one with world No 1 shuttler Ratchanok Intanon during her visit to Government House yesterday.

BADMINTON sensation Ratchanok Intanon yesterday visited Prime Minister Prayut Chan-o-cha at Government House and asked for help in getting her Chinese coach Xie Zhuhua Thai citizenship.

Today, Ratchanok, who made her impact after capturing three World Superseries tournaments in a row in just three weeks – the India Open, Malaysia Open and Singapore Open – is due to clinch the world No 1 seed officially after the Badminton World Federation’s weekly rankings update.

The 21-year-old from Yasothon was accompanied by Khunying Patama Leeswadtrakul, president of the Badminton Association of Thailand; Kamala Thongkorn, manager of Ratchanok’s home club Ban Thong Yod; her coach Pattapol Ngernsrisuk; and Chinese coach Xie.

Prayut lauded the Asian champion on her remarkable success, particularly in moving to the top of the world rankings. “I would like to congratulate Nong May on her resounding success to emerge as world No 1. I watched all three tournaments Nong May competed in.”

Prayut thanked the champ and her supporters for bringing success and happiness to Thais of all walks of life during Songkran.

//

“Until Nong May came this far, you were very exhausted. Win or lose, it’s up to your heart. Don’t put any pressure on yourself and keep physically fit to keep your title as long as possible.”

Prayut said he would assign officials to work on legal processes to meet the request for her Chinese coach. The prime minister presented the 2013 world champion a blazer and a Pakhaoma-patterned hand bag as souvenirs.

He also rallied a little with Ratchanok with a shuttlecock in front of the Thai Khu Fah Building.

Alternative building to Thai Khu Fah being built on PM’s orders

Land behind the Thai Khu Fah building in the Government House complex is being prepared for construction of a new single-floor lounge building following Prime Minister Prayut Chan-o-cha’s initiative. The building is expected to be completed by February ne

A VAST open grass field in the Government House compound stands behind the Thai Khu Fah building, but sooner that structure’s architectural magnificence will be complemented by a new lounge building.

The planned building, the first of its kind under the current military-led regime and its second structure after the installation of a giant flagpole, is now under construction.

The idea to construct the building came from Prime Minister Prayut Chan-o-cha, Pranee Sripaset Sripasert, deputy secretary-general to the PM for administrative affairs, told The Nation.

“The landmark Thai Khu Fah, as well as the Santi Maitree building, have been used so much that they never get to rest for a day,” Pranee said. “So PM Prayut thought that a new building would come in [handy] to help welcome his official guests and to host events.”

To be located on an open grass field behind Thai Khu Fah, the yet-to-be-named building will consist of a lounge with capacity for 150 to 200 people. The lounge can also be divided into several compartments.

Its architectural style, Pranee added, would be in harmony with those of the principal Thai Khu Fah and Santi Maitree buildings, which adopted neo-Venetian Gothic architecture combined with Byzantine art.

And as Prayut favours dignified beauty, the Army’s post engineering department is tasked with taking care of the construction project, the deputy secretary-general said.

Government House is a historical site registered with the Fine Arts Department, so the architectural team requested its approval, which was granted.

The Fine Arts officials have examined the project to ensure the structure will not corrupt the historically rich Thai Khu Fah.

Pranee explained that the Army department had been assigned to construct the building because it could contribute decent architects to the project.

To complete its artistic sophistication, the Fine Arts Department will also take care of new decoration on both of command buildings in next month, she said.

The project will allow the other buildings to function as usual, she added, as they house a number of Cabinet-related offices.

While the exact budget for the project and its source are yet to be revealed, she said the money was spared from that of the previous governments.

The project’s details and plans, once completed, will be put on display on the construction site, possibly by next week.

Although the project stemmed from Prayut‘s idea, Pranee denied it was simply a pet project of the general-turned-prime minister.

“This is being done for a long-term purpose, indeed. He wishes that the new building will have historical value like its forebears in the compound,” she said. “He said that any succeeding prime ministers should be served with sophisticated buildings, suiting their magnificent positions.

“To me, he is very detail-oriented,” Pranee said.
