True-Dtac Deal Is A More Severe Monopoly Than Socialism; NBTC Considered “Stubborn” In Not Recognizing Its Own Powers, Which Are Clearly Laid Out In The Law. NBTC Has The Authority To Give Or Withhold Permission. It Must Use These Existing Powers And Not Neglect Its Compliance With Section 157.

On September 7, the Thailand Consumers Council held a seminar to gather opinions on the case of “Whether NBTC has the authority to manage the True-Dtac merger.” Ideas and solutions were sought in the matter of consumer protection from business mergers.

Until now, National Broadcasting and Telecommunications Commission (NBTC) has not been able to conclude whether it can consider the request to merge the businesses of True and Dtac. It looks as if, even though NBTC board has read the reports from all four subcommittees which it established, it can still cannot yet come to a conclusion. One of these is the legal subcommittee, which clearly voted 10 to 1 that NBTC had authority to consider whether to approve or disapprove. However, NBTC submitted the matter of its own authority to the office of the Council of State to consider such authority for a second round, even though it was not a matter to bring in the executive branch to regulate itself.

Prof Dr Parinya Thewanarumitkul, a delegate from Thammasat University spoke about NBTC board’s behaviour. He said that looking back at the establishing laws of NBTC, the reason for an independent organization to regulate the national resource of RF spectra was to be compliant with the 2017 Constitution and the Announcement of NBTC concerning regulatory measures for business mergers of 2018. Section 9 of this Announcement stated that the report in Section 5 was considered to be a request for approval from NBTC under Section 8 of the NBTC Announcement concerning measures to prevent actions causing a monopoly or unfair competition in the telecom sector of 2006. NBTC has the authority to forbid a merger, if it falls into the scope of a monopoly, or reducing or limiting competition.

Then there is the objection that previously, nine merger deals had applied the NBTC Announcement of 2018, and that the words “report on the merger” are used to mean that according to the latest Announcement, companies did not have to request permission. They only had to make an acknowledging report, because NBTC did not have the authority for any action.
 

The nine previous deals should not be cited

Prof Parinya said that the True merger with Dtac could not be compared with these nine previous deals, because it fell into the scope of power over the market, and ownership of spectra, which are a natural resource. They would have a market share more of more than half, and clear power over the market, so why can’t they use the post-merger report system?

It is because of the nine deals mentioned, seven of them were mergers between licensees who are subsidiaries of the same parent group. One deal’s post-deal assets did not exceed the financial limits stipulated by the NBTC Announcement, and one deal was the merger of the state enterprise CAT Telecom with TOT to form NT, pursuant to a Cabinet resolution. Therefore, mergers which exceeded what was stipulated in the law gave the private sector a market share in excess of 50%, the scope of a monopoly more severe than a socialist economy.

Thus, NBTC, as the state organ charged with regulating spectra and providing telecom services has the obligation under Section 27 (11) of the Act on the Organization to Assign Radio frequency and to Regulate the Broadcasting and Telecommunications Services B.E. 2553 (2010) (“Radio Frequency Act”) to determine measures to protect any action which would be a monopoly or be the cause of unfair competition in telecom businesses. It also prevents or manages trade barriers or monopolies, protects consumers and eliminates unfair economic monopolies according to the state policy written in the Constitution, the country’s highest law.

“NBTC may not be confident in its own authority because this is a very large deal happening. However, both the Administrative Court and NBTC legal subcommittee have authority in this matter. Pretending not to know and then asking the Council of State may fall under negligence of duty, or illegitimate actions under Section 157.”

Because spectra are a national resource

Assoc Prof Dr Narongdej Surakosit of Chulalongkorn University’s Law Faculty commented that telecom businesses had to make massive investments which affected the interests of the state and the public. The bodies charged with regulation had to exercise oversight for the maximum benefit, which can be clearly seen written in the Constitution. This is why it was necessary to set up a state agency which was independent in the public interest. In this case, such a body was required to provide measures preventing the seeking of benefits from consumers, or taking advantage of consumers.

Therefore, the status of NBTC is an independent organization, established pursuant to the Act on the Organization to Assign Radio frequency and to Regulate the Broadcasting and Telecommunications Services B.E. 2553 (2010), and whose independence is endorsed by Section 60 of the 2017 Constitution of the Kingdom of Thailand.

Also, pursuant to Section 6, the state is required to maintain radio frequencies and access to satellite orbits as national property in the best interests of the country and its people. The allocation of spectra under Paragraph 1, for broadcasting, telecommunication or any other use, must be in the paramount interest of the general public, national security, public benefit and allowing the public to benefit from those spectra.

“Regulating business concerned with the national benefit must be strictly observed, because the more that it is a limited resource, the more that everything must be for the greatest benefit of the public and the nation in accessing them, and specific powers have been granted to NBTC. Therefore, if you ask whether NBTC has authority to consider this matter, the easy answer is, yes, it has full authority.”

The Event Is Called “Let’s Unbox! 2022 Hong Kong Art Toy Story Exhibition, Thailand Chapter”.

The first of its kind large-scale exhibition in Thailand which displays world class art toys all by Hong Kong famous designers will open to toy lovers and general public this Friday (September 9) until September 18, 2022. Titled “Let’s Unbox! 2022 Hong Kong Art Toy Story Exhibition, Thailand Chapter”, the Exhibition is organized by the Innovative Entrepreneur Association (IEA) in celebration of the 25th Anniversary of the Establishment of the Hong Kong Special Administrative Region (HKSAR) under the support of Create Hong Kong of the HKSAR Government as the Lead Sponsor.

The Exhibition will be held in the popular shopping center centralwOrld in Bangkok, Thailand, featuring the best collections from 15 units of Hong Kong top art toy designers, namely Foon Wong (Big boy toy), Husky Kevin, Ma Fai, Miloza Ma, Pat Lee, Pucky, Winson Ma, Felix Ip, Jeffery Yau, Lam Pei, Mickey Mic, Nicolas Lesaffre, Ryan Lee, Spooky work and Steven Choi.

As the travel rebound continues to unfold, the benefits of tourism are spreading across the Asia Pacific. In Southeast Asia, particulary Thailand, Airbnb reveals that the resurgence in domestic and inbound tourism is empowering locals to earn a living and make ends meet.

Airbnb shows how tourism has benefited rural communities in Thailand 

In Thailand, some of the lesser-known destinations that travellers are exploring include Koh Lanta, Trat, Pai and Cha-am.

Domestically, more than 70 per cent of Thais polled plan to travel more frequently to rural destinations that are not currently popular with tourists, and over two-thirds polled say it is important that they are not contributing to issues such as over-tourism.

With people continuing to embrace flexible new approaches to travel and living, communities that have traditionally missed out in the past are increasingly well-positioned to secure a bigger slice of the tourism pie, according to the new Airbnb report ‘Further Afield: Spreading the Benefits of the Travel Revolution’.

Across the region, this has presented fresh opportunities for locals looking to supplement their income as they grapple with rising costs of living.

Across the Asia Pacific, Airbnb nights booked in non-urban areas and typical earnings for non-urban Hosts have increased. Travellers are not only eyeing destinations off the beaten path, but they’re also looking to stay longer.

Notably, nights booked for long-term stays (stays longer than 28 days) in non-urban areas approximately doubled in popular travel and remote working hotspot Thailand in Q2 2022, up from Q2 2019 pre-pandemic.

In Southeast Asia, a number of destinations outside major metropolitan hubs were popular among travellers on Airbnb for long-term stays in Q2 2022. Examples included:

When someone mention cryptocurrency, Bitcoin is likely the first thing that comes to mind. However, there is another that is also gaining more spotlight, Ethereum or ETH, the 2nd largest cryptocurrency in term of marketcap.

The Merge and The Evolution to Ethereum 2.0

Ethereum was founded by Vitalik Buterin and launched in 2015. Unlike Bitcoin, Ethereum blockchain supports Smart Contract which allow developers to create decentralized applications, leading to new innovations on the blockchain including Decentralized Finance, GameFi, Stablecoin, NFT and many more. Ethereum is considered the first of 2nd generation blockchain.

However, Ethereum still has its limitation which lead to the idea of developing Ethereum 2.0 that will enhance many functions including speed, decentralization, and security. In this article, we will learn more about why Ethereum aims to become 2.0 and how it plans to do so.
 

The Merge, First Step to Ethereum 2.0

The Merge and The Evolution to Ethereum 2.0

The Merge is the event that is predicted to happen in September 2022. It is when Ethereum will finally change its consensus algorithm from Proof-of-Work (PoW) to Proof-of-Stake (PoS) which is widely used by new generation of blockchains.

The idea behind the Merge was dated back to 2020. During the time, Ethereum developers have created another blockchain called Beacon Chain which used PoS and allowing ETH holders to stake their ETH on the network to help secure and develop the network. When the network is ready, it will undergo a process called “The Merge” where Beacon Chain merges with Ethereum mainnet and changing mainnet’s consensus to PoS.
 

Why is changing to PoS important? Because Ethereum currently uses PoW to verify transaction on the network which requires mining or using computers to solve equations in order to create a block. Mining consumes huge amount of electricity, to make the matter worse, the bigger the blockchain the more competition between miners are, resulting in even more electricity wasted to run the network. There was a report that Ethereum consumes electricity almost 112 TwH/year which can be compared to the amount required by a small country in one year.

This is why PoS considered a game-changing for Ethereum, as it completely changes how the network process a transaction from running a mining rig to staking coins. ETH holders can stake their coins on the blockchain as collateral in order to be randomly selected by the system to validate a transaction and create a block, the validator then receives ETH as reward for performing the task correctly and with integrity. Without mining, Ethereum is predicted to be able to reduce its energy consumption by almost 99%.

Next Steps for Ethereum 

While The Merge is just weeks away, it is actually the very first step to Ethereum 2.0 that will solve the energy consumption issue. The other issues which include transaction speed, decentralization, and security will be addressed in the next milestones with the rhyming names and details as followed:

The Surge

This step will introduce Sharding to the ecosystem. Sharding is the system that split information into smaller packages and distribute these packages to be processed by each node in blockhain, also known as Pararelle Processing. With this, Vitalik Buterin the co-founder believes that it could speed up the transaction time to 100,000 transactions per second compared to current speed at 15 – 20 transactions per second. 

The Verge

This step will introduce “Verkle trees” and “Stateless clients” into Ethereum ecosystem allowing users to run a node without requiring to store an immense amount of data, which in turn is an incentive to increase the number of nodes, and ultimately leading to more decentralization.

The Purge

This step aims to cut down some unrelated historical data to free up spaces as well as to remove Technical Debts that were created during initial stage of development to ensure more sustainability of the network in the long-run.

The Splurge

At present, the hemodialysis unit of Thammasat University Hospital needed to increase the round of dialysis services daily to accommodate more patients. In the upper central region, Thammasat University Hospital is considered to be the only hospital that can provide comprehensive medical services. Therefore, people living in nearby provinces like Saraburi and Phra Nakhon Si Ayutthaya do not have to travel to Bangkok. The hospital also receives referrals from other hospitals in the Northern Bangkok area, the Upper Central region, the lower Northern region and the North Eastern region, resulting in a high number of patients. Consequently, the facility and medical equipment are insufficient for treatment and services.

Gulf Energy Development Public Company Limited (GULF) recognizes the importance of this issue so for that reason, the company presented a donation of 55 million baht to Thammasat University Hospital to fund the establishment of the state-of-the-art Hemodialysis Center with 30 high-efficiency on-line hemodiafiltration machines to provide disadvantaged patients with chronic renal failure access to comprehensive and standardized treatment. The center also aims to be the Center of Excellence, offering comprehensive for patients with kidney disease and patients in need of kidney replacement therapy; acute hemodialysis, chronic hemodialysis, peritoneal dialysis, kidney transplant surgery, plasmapheresis, etc. In addition, the center will be an on-site teaching facility for medical students, nursing student and resident physicians specializing in nephrology. This is in line with GULF’s mission to promote public health along with improving the quality of life of people in the community.

Therefore, the hospital has to increase the service rounds to 3 times per day. However, the center is still not capable of providing service to every patient, causing delay or inadequate treatment. In order to support the hospital’s mission of providing underprivileged patients with equal access to medical care, Thammasat Hospital therefore carries on a policy with the opening of 30 high-efficiency advanced hemodialysis units to expand the potential and help patients with kidney disease in the long run. Hemodialysis Center with Advanced Technologies is located on the 4th floor in the laboratory and diagnostic radiology building, Thammasat University Hospital. With a total area of 900 square meters, the center is equipped with 30 dialysis machines with innovative technology and smart IT system to assess the methods of dialysis. The amount of fluid required for each patient is calculated by weight, blood tests, including the patient’s vital signs during dialysis to optimize the dialysis treatment according to the symptoms. In addition, the dialysis machine uses two waste disposal processes combined, namely the diffusion process, and the convection process, which are mostly used in European countries thanks to its efficiency to eliminate large molecular waste in the body which traditional dialysis cannot do as well as help reduce infection, side effects, complication rate including mortality rate. Overall, it will allow patients to have a better quality of life and longer lifespan. Currently, the Hemodialysis Center is under construction and expected to be open within 2023.

Sasin School of Management has developed the Social Progress Index (SPI) for the Provinces of Thailand (SPI Thailand) in collaboration with Social Progress Imperative, a global nonprofit based in Washington D.C., which has provided technical expertise and support to Sasin in developing the index.

SPI is a comprehensive, non-economic index launched in 2014 to measure the actual lived experience of people in different countries by looking at three dimensions: basic human needs, foundations of well-being, and opportunity. 

Since May 2020, Sasin’s SPI Working Team has been sourcing data at the provincial level from various official data sources to cover at least 40 environmental and social indicators to be included in the final framework of the SPI Provincial Index for Thailand. In 2021, Thailand’s SPI Index ranked 71st out of 168 countries.

Understanding customers and their unique needs and preferences is the key to good communication and a positive Customer Experience (CX).

For this purpose, Infobip, a global cloud communications platform that enables businesses to build connected customer experiences across all stages of the customer journey, have commissioned a study titled Redefining Human and Automated Engagement – How APAC Consumers Have Impacted The CX Agenda.

The custom study, commissioned by Infobip was conducted by Forrester Consulting across 1,210 consumers in mainland China, Hong Kong, Indonesia, Japan, Malaysia, Philippines, Singapore, South Korea, Thailand, Taiwan, and Vietnam.

The study identified 4 types of decision-makers with four distinct personas that emerged in the digitalization age, whom decision-makers must consciously cater to in their digital and in-person engagements.

1. Affluent Hybrid Shoppers
Young adults aged 25 to 39 years old, with high income. They prefer both human-assisted service and digital touchpoints. They are comfortable with switching communication across touchpoints during the interaction.

2. Reserved High Touch Seekers
45 years and over with medium income. Prefer human touchpoints, without having to switch communication across platforms. Digital touchpoints are less important for this group, and they tend to feel less safe with digital interactions.

3. Neutrals
Adults ages 30 to 44 years old. This group does not have a clear touchpoint preference but is less comfortable with switching communication across touchpoints during the interaction.

4. Low-Touch Digital Natives
24 years and under with low or medium income. This Gen Z group prefers to keep communications digital, with high confidence in digital interactions. Human touchpoints are less important for them. 

For Thailand, results show that Affluent Hybrid Shoppers (59%) favoured switching between digital and human touchpoints, whilst Reserved High Touch Seekers (17%) were inclined to trust touchpoints with a human agent. On the other hand, Neutrals (15%) were reluctant to switch communication across touchpoints, and Low-touch Digital Natives (8%) were younger and leaned toward digital touchpoints.

While reaffirming how hybrid touchpoints are key, distinguishing between the unique needs of customer personas is another key factor in enabling positive CX. Therefore, catering to the diverse needs of these personas is crucial. In this age of digitalization, it is imperative to optimize the hybrid experience for customers based on their personal preferences. However, to enable this, organizations need internal capabilities to build flexibility and agility among their customer touchpoints.

Thailand, with its rising e-commerce trend, led by the Covid-19 pandemic and rising digitalization has seen a shift towards more and more omnichannel communication preferences among consumers.

This means that customers are now demanding a communication experience that combines touchpoints from both online and offline into one fully integrated platform.

To do this, brands can take advantage of tools such as a centralised omnichannel cloud contact centre solution, which will enable them to seamlessly integrate conversations across communication channels, accessible via one single agent interface. This in turn will help to streamline customer conversation for a better overall CX and customer retention.

All-in-all, technology plays a crucial role in determining positive CX in this modern day, where personas are diverse and customers are becoming increasingly demanding of their ‘personalised’ experience.

Therefore, investments in processes and tools to boost these services, both human-led and through artificial intelligence (AI) are key to achieving seamless communication, as well as synergizing capabilities of both machine and man for CX excellence and improved customer satisfaction.
