7-Eleven wins case against OKnation blogger over libel


The Bangkok South Civil Court ordered a blogger to pay CP All a compensation of Bt80,000 at 7.5 per cent interest per year for breaching a contract settlement with the company in a libel case.

The court’s verdict came on August 31.

CP All Public Company Limited, the owner of the 7-Eleven convenience store franchise in Thailand, filed the contract-breaching case against Shin Ratithamkul, an OKnation blogger.

Back in April 2015, Shin had published a two-part article on the OKnation website alleging that CP All had copied the recipe of a banana custard snack from a small business owner, who had proposed to sell the snack in stores. Shin’s article claimed that CP All was “a giant conglomerate that is picking on and taking advantage of small entrepreneurs”.

CP All filed a libel case against Shin in 2016, leading to a court settlement between both parties, in which the company agreed to withdraw the charge while Shin was required to publish a written apology and the settlement agreement on the OKnation website from March 29 to December 31, 2017.

However, later that year CP All found that Shin did not honour the settlement terms and therefore filed the contract-breaching case against him at the Bangkok South Civil Court.

The court subsequently found Shin guilty and ordered him to pay Bt80,000 in compensation to the company at 7.5 per cent interest per year since the case was filed.

Shin was also required to publish within 30 days the settlement agreement on the OKnation website for eight months and 26 days.

Thailand recorded 16,031 Covid-19 cases and 220 deaths on Thursday


Ministry of Public Health reported on Thursday (September 9) morning that in the past 24 hours there are 16,031 new patients who tested positive for Covid-19, 631 of whom have been found in prisons.

Death toll increased by 220, while 15,417 patients were cured and allowed to leave hospitals.

Cumulative cases in the country are at 1,338,550 with 13,731 total deaths.

Thundershowers with isolated heavy rains forecast across country


Keep your umbrella or raincoat at hand: thundershowers are forecast over Thailand with isolated heavy rains in the lower Northeast, the Central region, the East and the South amid an active monsoon trough even while the strong southwest monsoon prevails across the country, the Andaman Sea and the Gulf of Thailand, the Meteorological Department said on Thursday.

The department warned people in these areas to beware of rain water accumulation that may cause flash floods and advised all ships to proceed with caution and small boats to stay ashore as waves in the Andaman Sea are 2-3 metres high and above 3 metres in areas experiencing thundershowers.

Bangkok and surrounding areas: Thundershowers in 80 per cent of the area with isolated heavy rains; temperature lows of 23-25 degrees, highs of 31-32 degrees Celsius.

North: Thundershowers in 80 per cent of the area with isolated heavy rains; temperature lows of 23-24 degrees and highs of 29-32 degrees Celsius.

Northeast: Thundershowers in 80 per cent of the area with isolated heavy rains; temperature lows of 23-25 degrees and highs of 26-30 degrees Celsius.

Central: Thundershowers in 80 per cent of the area with isolated heavy rains; temperature lows of 22-24 degrees, highs of 31-32 degrees Celsius.

East: Thundershowers in 80 per cent of the area with isolated heavy rains; temperature lows of 23-24 degrees, highs of 27-32 degrees Celsius; waves 2 metres high and over 2 metres during thundershowers.

Insurers delaying Covid payments face THB20,000 daily fine, warns OIC


The Office of the Insurance Commission (OIC) has warned insurance companies after complaints of late payments on Covid-19 policies.

OIC chief Suthiphon Thaveechaiyagarn said companies refusing to pay out on a legitimate Covid-19 claim faced daily fines of 20,000 baht up to a maximum of 500,000 baht under the law.

Serious action in response to complaints against insurers will be considered by the OIC’s penalty committee next Tuesday (September 14), he added.

The warning comes after the OIC implemented measures on September 1 to speed up the Covid-19 insurance claims process, including panels to mediate disputes between insurers and customers.

Suthiphon said the OIC had received 1,671 complaints about Covid-19 insurance this year.

One insurer says Covid claims from its customers have soared above 1,000 per day, causing delays in payouts.

The Digital Economy and Society (DES) Ministry says it is coordinating with hospitals nationwide to plug any gaps in their data systems after 16 million medical records were found for sale online.

DES Minister Chaiwut Thanakamanusorn said the data leak at Phetchabun Hospital in the lower-North was from a new internal system that may not meet data-security standards. He added that internet connections to hospital data systems had been suspended and log-in records were being checked in a bid to find the hacker.

Meanwhile, rumours that as many as 30 million records were stolen from the hospital were likely false, said the National Cyber ​​Security Commission.

Commission deputy chief Amorn Chomchai explained that the hackers appeared to have released the stolen data for sale online in July before withdrawing it and then releasing the same data for sale again.

FDA considers Sinopharm jabs for children aged 3+


Biogenetech, the licensed importer of Sinopharm vaccines, has submitted documents with the Thai Food and Drug Administration (FDA) on using the vaccine for children aged three and above.

The application was submitted on September 2.

Dr Paisan Dankhum, FDA secretary-general, said the authorities will take no more than 30 days to consider the application.

Sinopharm has been approved for people above the age of 18, while Moderna and Pfizer jabs are allowed for children aged 12 and above.

Bangkok switching to mix-and-match jab formula next week


Bangkok will switch its vaccination drive from double AstraZeneca doses to a cocktail of Sinovac and AstraZeneca, starting next Tuesday (September 14).

The Bangkok Metropolitan Administration (BMA) said the switch is in line with Public Health Ministry guidelines for Dark Red Zone provinces of high infections and controls.

Giving Sinovac as a first dose followed by AstraZeneca as the second dose could be done in three weeks instead of the 12-week gap required for two AstraZeneca jabs, explained the BMA.

The Cabinet on Tuesday approved a budget of 4.25 billion baht to procure another 12 million doses of Sinovac for the mix-and-match programme.

The BMA said 59,238 Covid-19 vaccine jabs were administered in the capital on Wednesday, taking the total number of doses administered in Bangkok to almost 10 million (9,872,041 doses).

Mor Prom app confirmed as Digital Health Pass for Thai air travel


The government’s Mor Prom app will be used as the Digital Health Pass for air passengers in Thailand, under an agreement reached on Wednesday by the Public Health Ministry, Civil Aviation Authority of Thailand, and the Thai Airlines Association.

The app will be used during the boarding process to check whether passengers have been vaccinated – a requirement for domestic air travel.

Ministry permanent secretary Kiattiphum Wongrajit said the move was part of “universal prevention” measures to open the country safely. Other measures include vaccination, testing, the bubble-and-seal policy, and Covid-Free Settings, he added.

Foreign Ministry denies being lax in procuring jabs from other countries


The Foreign Ministry on Wednesday dismissed accusations that it has refused to cooperate with other countries to procure Covid-19 vaccines.

“The ministry has used various channels, such as vaccine swaps, accepting donations and negotiating on vaccine research and development,” said ministry spokesperson Tanee Sangrat.

He gave the example of Thailand’s recent vaccine swap with Singapore, similar to the deal done earlier with Bhutan.

“Singapore was willing to deliver 120,000 doses of AstraZeneca vaccine in return for Thailand’s donation of RT-PCR test kits at the beginning of Covid-19 crisis,” he explained. “However, we decided to do the vaccine swap with Singapore as we believe that every country should help together [to overcome the crisis].”

He also denied accusations that a Moderna representative was unable to contact Thai diplomats with news of a delivery delay, saying the ministry and Royal Thai Embassy in Washington DC had received an e-mail from a pharmaceutical company responsible for Moderna vaccine supply and distribution in Thailand.

“In the e-mail, the representative asked to postpone the delivery of 10 million doses of Moderna vaccine scheduled in the third quarter of this year … as the company’s factory in Switzerland had faced difficulties,” he said.

“The representative did not reveal any documents related to Thailand’s purchase order, such as the number of vaccines or delivery timeframe.”

He added that the Thai Embassy in Washington is contacting US representatives to accelerate the delivery of vaccines and increase the supply.

The Foreign Ministry had also cooperated with China, Japan, the UK, Bhutan, Germany and Switzerland to tackle the Covid-19 crisis, said Tanee.

“In addition, the ministry is currently in talks for vaccine procurement with India, and for public health support with South Korea and Australia,” he added.

He asked people not to make baseless accusations against ministry officials worldwide, saying this would result in confusion among civil servants and the public.

Vaccination buses roll out to protect at-risk Bangkokians


The first Bangkok Mobile Vaccination Unit (BMV) was inspected by city governor Aswin Kwanmuang on Wednesday.

Aswin visited Wat Thep Nari in Bang Phlat district to oversee the first phase of the BMV project, which is vaccinating at-risk residents of Covid-19 hotspots in the capital.

Bang Phlat has suffered serious outbreaks in entertainment venues and a construction camp.

The mobile vaccination units mean residents will not have to travel far for jabs, reducing the risk of the virus spreading via public transport. The BMVs can also be quickly redeployed to virus hotspots as needed, said the Bangkok Metropolitan Administration (BMA).

District offices will manage the vaccination lists and queues to minimise waiting times and prevent crowding at the BMVs, it added.

The first phase of the project is vaccinating the elderly, people with any of seven underlying health conditions, and disabled people. The project will then offer jabs to the wider population.

On arriving at the mobile vaccination unit, people will be screened and asked to sign the vaccination consent form. Their ID card will then be verified before they receive a dose of vaccine. They will then be monitored for any side effects for 30 minutes and receive an appointment for their second dose.

Each BMV can vaccinate 1,000 people per day. The BMA will deploy seven more of the mobile units to service Bangkok communities on Friday.
