Top HK court makes ruling protecting transgender rights

TUESDAY, FEBRUARY 07, 2023

Hong Kong’s top court on Monday ruled that the policy of barring transgender people from changing their gender shown on ID cards unless they undergo full sex reassignment surgery violates their rights and is unconstitutional.

The Court of Final Appeal unanimously sided with appeals launched by transgender activists Henry Tse and another appellant identified as “Q” and quashed the Commissioner of Registration’s decision to refuse their applications to change their gender on their Hong Kong Identity Cards.

“The policy’s consequence is to place persons like the appellants in the dilemma of having to choose whether to suffer regular violations of their privacy rights or to undergo highly invasive and medically unnecessary surgery, infringing their right to bodily integrity,” the judges wrote in their judgment.

“Clearly this does not reflect a reasonable balance. The policy imposes an unacceptably harsh burden on the individuals concerned.”

Both Tse and Q underwent lengthy medical and surgical treatments, including hormonal treatment and removal of breasts, but the registrar still required them to conduct a full sex reassignment surgery, which the pair argued was unnecessary, unwanted and highly invasive.

Tse welcomed the judgment as it would solve the “burning issues” he encountered due to possessing a wrong ID and he called for a gender recognition law.

“Today’s result is delayed justice, a Pyrrhic victory. This very case should never have happened,” Tse said in a statement.

“I will continue to work hard to plant the seeds for the transgender rights movement with my partners at Transgender Equality Hong Kong. I believe that one day, we shall succeed and welcome the rainbow with open arms.”

Trat province’s Koh Mak will serve as a role model for developing sustainable tourism under the so-called Bio-Circular-Green (BCG) economic model after winning international recognition as a green destination, Tourism and Sports Minister Phiphat Ratchakitprakarn said on Wednesday.

The 12.4 square kilometre island in Trat province is named after the areca nut, also known as the “betel nut”.

Phiphat made the comment during a ceremony held to congratulate representatives from the island on its green destination award and present them with a plaque titled “2022 Green Destinations Top 100 Stories”.

The Green Destinations Top 100 Stories awards are from the website Green Destinations. The website says the programme celebrating and promoting 100 destinations as inspiring examples for other destinations, tour operators and visitors has run annually since 2014.

‘Betel nut island’ to be a role model for green tourism, minister saysThe Designated Areas for Sustainable Tourism Administration will use Koh Mak as a model for developing other tourist destinations to become green destinations under the BCG economic model, Phiphat said.

The BCG model will focus on quality tourists, rather than quantity, and will ensure tourism is sustainable through proper environmental management and fair distribution of income to local residents, he said.

The Designated Areas for Sustainable Tourism Administration has prioritised environmental protection in its development of Koh Mak and, as a result, it has become a clean, convenient and safe destination, Phiphat said.

‘Betel nut island’ to be a role model for green tourism, minister says“As a result, Koh Mak is the role model for tourist destination islands of Thailand in terms of safety and measures for handling garbage,” he explained.

Atikhun Kongmee, director of the Designated Areas for Sustainable Tourism Administration, said the agency would further develop Koh Mak so that it would win more prestigious recognition from the Green Destinations this year.

The best stories from the Top 100 list will be selected by a jury to be nominated for the Green Destinations Story Awards at ITB Berlin, an international travel exhibition.

Atikhun said it would be a challenge for his agency to push Koh Mak for the award because the Top 100 Stories destinations must meet 15 criteria while the Green Destinations Story Awards must meet 30.

A collaboration between two gems and jewellery bodies and state authorities aims to project Thai gems as the country’s soft power

The Thai Gems and Jewellery Traders Association (TGJTA) and the Gems Jewellery and Precious Metal Confederation of Thailand (GJPCT) announced their collaboration with the Ministry of Tourism and Sports and the Tourism Authority of Thailand (TAT) to promote “Ploi Thai” (Thai gems).

The goal is to make Thai gems as popular as Muay Thai.

TAT Governor Yuthasak Suparson told a press conference on Tuesday evening that Thailand is still regarded as “The Capital of Gemstones” by global partners. This sparked the idea of creating soft power “Ploi Thai” in order to increase its popularity among tourists and the general public on a global scale.

He said that given the current state of the tourism industry, it was crucial to find new ways to distinguish Thailand from other destinations by emphasising Thai soft power and cultural experience.

Aside from Thai street foods, Thai boxing, friendly people, and their generous nature, Thailand’s gems and jewellery are also well-known for their delicate work and creativity, he said.

He pointed out that the sector is a vital part of the country’s economy. Thailand is currently the third largest exporter of gems and jewellery, worth 500 billion baht, and provides employment to millions of locals.

“The TAT has decided to collaborate with the TGJTA and the GJPCT to organise the Thailand Gems & Jewellery Fair in order to encourage tourists from all over the world to come and buy the best quality gems, or ‘Thai gems’, generating foreign currency income and being a tourism destination, as well as creating soft power to strengthen sustainable tourism,” the TAT governor said.

Porntiva Niparin, president of the TGJTA, invited all Thais to attend this fair in order to work together to build a strong economy in Thailand.

GJPCT president Somchai Phornchindarak said that the group is putting on this show to help Thailand become a leader in the global gems and jewellery market.

According to him, the Thailand Gems and Jewellery Fair, the only fair organised by stakeholders, has established itself as one of the leading events in the gems and jewellery sector. This year’s fair will feature a diverse range of local and international exhibitors from Sri Lanka, Hong Kong, Turkey, Japan, China, Singapore, Poland, Myanmar, and others.

The fair allows buyers to source colour stones directly from Thailand, the world’s gemstone capital. Thais have expertise in enhancing and cutting fine quality gemstones. This fair is also expected to serve as a one-stop shop for gems and jewellery manufacturing, offering a wide variety of diamonds, gems, and jewellery clusters.

The launch of the “Standard Colorstone Price Guide” is one of the edition’s highlights. The guide provides a standardised pricing system for coloured gemstones based on factors such as colour, clarity, and weight, as well as terminology commonly used in quality grading standards in China and Thailand to help ensure that prices are consistent across the industry.

The price guide is intended to benefit both buyers and sellers by providing a reliable reference to determine the value of gems, assist in creating confidence and expanding the market.

The annual “Thailand Gems and Jewellery Fair 2023” is scheduled to take place at Impact Challenger Muang Thong Thani from February 22-26. The event promises to be a showcase of the finest and most unique gems and jewellery from around the world.
More than 1,000 booths of exhibitors and visitors from all corners of the industry are expected to participate. The fair is free and open to the public.

Debate on opposition’s charter amendment bill collapses as senators stay away

WEDNESDAY, FEBRUARY 08, 2023

A joint sitting of MPs and senators to discuss a charter amendment bill proposed by the Pheu Thai Party collapsed due to a lack of quorum on Wednesday, as most senators were absent.

The joint House-Senate sitting was scheduled to deliberate on the bill sponsored by the main opposition Pheu Thai to remove the power of senators to join MPs in electing the prime minister.

The meeting started at 11.10am after Parliament President Chuan Leekpai waited for over two hours for MPs and senators to enter the convention hall.

After 342 out of 665 current MPs and senators reported their presence by inserting their parliamentary ID cards into the card readers at their seats, Chuan announced the start of the meeting. A joint sitting requires the presence of 333 members to achieve the quorum.

At that time, only 52 out of 249 senators identified themselves as being present.

However, the meeting could not start deliberations on the bill as Somchai Sawaengkan, a senator, sought a vote on whether the rescheduling of the charter amendment bill atop the meeting agenda violated Parliament’s meeting regulations.

This prompted Chuan to call senators and MPs to reconfirm their presence at 11.28am. After a long wait, Chuan announced at noon that the meeting had to be closed because there were only 308 MPs and senators present.

It was reported that deputy Senate speaker, General Singsuek Singprai, had told senators to decline to report their presence in a tactic to deny the quorum and derail the bill.

Prayut failed to honour promises made before coup, Chuwit says

WEDNESDAY, FEBRUARY 08, 2023

Prime Minister Gen Prayut Chan-o-cha has failed to honour two of the promises he made when he seized power in a coup eight years ago – to eliminate online gambling and corruption, especially among the police, whistleblower Chuwit Kamolvisit said.

When Prayut seized power by toppling the Yingluck Shinawatra government on May 22 2014, he promised to wipe out corruption and crack down on gambling, the former politician and massage parlor wrote on Facebook late Tuesday night.

Prayut has been done to eliminate corruption by police, he said. They are still taking bribes, and this allows social-vice businesses, especially online gambling, to thrive, he added.

“The prime minister has been in power for eight years following the power seizure [for which he] cited corruption as a cause. He has absolute power like Field Marshal Plaek Phibunsongkham in the past, but he didn’t act to wipe out or lessen corruption,” Chuwit said. “Instead, he has become a part of the system of nepotism that continues without doing anything.”

By noon Wednesday, the post had been “liked” more than 8,800 times, shared over 510 times, and received more than 530 comments.

Chuwit recently exposed several incidents of alleged corruption by police. He also helped organise a press conference in Bangkok at which a Singaporean friend of a Taiwanese actress said Thai police extorted 27,000 baht as a bribe from the actress and her friends at a Bangkok checkpoint early last month.

There are several Chinese triads operating in Thailand because of corruption at the Immigration Bureau, he said.

Prayut failed to honour promises made before coup, Chuwit saysOnline gambling has intensified during the past few years and three key police agencies in charge of suppressing online crimes are instead being used by the officers in charge for personal gain, Chuwit said.

They are the Cyber Crime Investigation Bureau, Cyber Crime Investigation Division 5, and the Police Cyber Taskforce, he said.

Police set up road checkpoints to extort money from foreign tourists and pass on the biggest share of the bribes to their superiors, Chuwit said.

Money laundering and human trafficking suspects can buy their freedom by paying bribes to senior officials at various levels in the judicial system, he said.

Court releases hunger strikers, refuses bail for Thalugaz protesters

WEDNESDAY, FEBRUARY 08, 2023

The Criminal Court refused bail release for eight anti-government Thalugaz protesters on Tuesday – the same day it granted temporary release to two activists on hunger strike.

The court ruled that charges against three of the Thalugaz suspects, who are accused of using small explosive devices, were too serious to grant them temporary release.

It added that their bail requests had already been rejected several times.

The court said it would consider granting bail to one suspect after examining his education and job records.

It also ordered probation officers to check the job records and behaviour of the four remaining suspects, adding it would decide on their bail application within 15 days.

The Thalugaz group comprises mainly vocational school and college students. Last year, they clashed with riot police in Bangkok on numerous occasions during protests against the Prayut Chan-o-cha government. In contrast with peaceful anti-government demonstrations, Thalugaz protesters have used firecrackers, glass pellets and flares against riot police, while also setting fire to a patrol car.

Also on Tuesday, the court granted temporary release to Tantawan Tuatulanon and Orawan Phuphong after the health of the two hunger-striking activists reportedly deteriorated to a life-threatening level.

The bail request came from Thammasat University Hospital’s director, who said the pair were now in critical condition after launching their hunger strike on January 18. Tantawan and Orawan are charged with insulting the royal family by conducting a public opinion poll on royal motorcades in February last year. They went on hunger strike to demand an end to prosecution of people for exercising freedom of expression, and repeal of the lese majeste (royal insult) law that carries up to 15 years in jail and the sedition law.

TUESDAY, FEBRUARY 07, 2023

Prime Minister General Prayut Chan-o-cha said he has yet to decide whether he will contest as a party-list candidate for the United Thai Nation Party (UTNP).

Speaking to reporters after chairing the weekly Cabinet meeting on Tuesday, Prayut said he has not yet decided whether he will run for a House seat along with trying to get re-elected as prime minister.

“I still don’t know. I’ll tell you when it’s time,” Prayut said when reporters asked to confirm speculation that he will become UTNP’s first party-list MP.

Prayut had said he would stand as the party’s only PM candidate.

Under the Constitution, Prayut can hold the prime minister’s seat for another two years if re-elected in the next general election, scheduled tentatively for May 7.

Prayut said he has told UTNP’s tentative candidates to be careful while campaigning and avoid criticising coalition partners.

It was earlier reported that some candidates of Bhumjaithai Party, which is a coalition partner, had attacked Prayut in their campaign speeches.

Before the Cabinet meeting on Tuesday, Public Health Minister Anutin Charnvirakul was seen approaching the premier for a private chat.

Prayut said Anutin had shown up to explain why members of his party had attacked him while campaigning.

“It’s a non-issue. Anutin met me to explain it,” Prayut said.

Top Thai court issues arrest warrant for ex-interior minister Jarupong

TUESDAY, FEBRUARY 07, 2023

The Supreme Court’s Criminal Division for Persons Holding Political Position has issued an arrest warrant for former interior minister Jarupong Ruangsuwan over a graft case dating back to 2012.

The warrant was issued because Jarupong failed to attend the first hearing on December 13, the court said. Jarupong had assigned his lawyer to represent him in court on that day.

The former minister is being sued for unlawfully taking gifts worth more than 3,000 baht from a private company twice in 2012 and 2013.

Thailand’s anti-corruption laws prohibit state officials from receiving gifts worth more than 3,000 baht from private companies.

According to the lawsuit, Jarupong flew business class on China Airlines from Bangkok to Beijing and back in 2012 and then again to Kuala Lumpur and back in 2013.

The former minister then reportedly had Eastern Water Resources Development and Management Plc reimburse him for the two round-trip tickets worth 39,000 baht and 20,000 baht, respectively. The reimbursement was allegedly sought even though Jarupong had no direct links with the company.

Thailand will be officially free of African Horse Sickness this year: govt

WEDNESDAY, FEBRUARY 08, 2023

Thailand has asked the World Organisation for Animal Health (WOAH) to endorse its status of being free from the African Horse Sickness (AHS) so that the kingdom can resume international equestrian events, a government spokeswoman said on Wednesday.

The government submitted a request to the organisation on January 30 to endorse Thailand as being free of the disease and believes the organisation will agree to the request this year, deputy spokeswoman Ratchada Dhnadirek said.

AHS is an infectious disease affecting all species of horses (including mules, donkeys, and zebras). It attacks the respiratory and circulatory systems, and has a high mortality rate. AHS serotype one was first reported in Thailand in March 2020. It was the first time the disease was found in Asia.

After the outbreak was detected on March 27, 2020, 610 horses in 17 provinces became sick from the disease and 568 of them died, Ratchada said.Thailand will be officially free of African Horse Sickness this year: govt

The Department of Livestock Development and partner agencies have been working diligently to control and eliminate the disease, she said.

The disease has not been detected in Thailand for more than two years.

The Department of Livestock Development, the Royal Thai Army’s Animal Department, the Zoological Park Organisation of Thailand, and the Thailand Equestrian Federation have prepared all the necessary documents for the Thai government to show the WOAH that Thailand is free of the disease, Ratchada said.Thailand will be officially free of African Horse Sickness this year: govt

WOAH’s scientific committee will need some time to review the documents before it officially declares Thailand free of the disease, she said.

After Thailand regains its AHS-free status, it will be eligible to host international equestrian competitions, import and export horses, and allow them to be freely transported throughout the country.Thailand will be officially free of African Horse Sickness this year: govt
